Speeding ticket after 4 months

    I've send a letter before hand without naming the driver. I've called today the police station and ask what is the status on my case. They said that they haven't received any letter from me (Which was sent via 1st Class RM on the 19.03) and that they will extend the period for me for another 7 days.(which was actually very cool for them to do) and I think I will give up as it's actually much way more hustle than it's worth it and I think I'll put my self on the form just to have it off my hand. There were people at the time who were driving the car from other countries so I don't know how that would work as well.

    Edit to say isn't the 28 days up today? If so an email followed up by a letter may be sufficient to stave off a FtF prosecution.

    CPS prefer to prosecute when there’s a realistic prospect of winning. The op has just handed them that prospect.

    Of course there were, in that case you should name the driver who no doubt you added onto your insurance and he was suitably licenced.


    If you weren’t the driver then why are you saying you were?

    You’ve lost any chance of a course and most probably looking at court rather than a ticket. Google perverting the course of justice and don’t turn it into jail time.

    Not really. By your own account, you're lying to the law and falsely accepting blame, not fighting it. I don't remember that old song.

    Just be honest, look into which of your overseas acquaintances was driving it and notify accordingly. Your insurance records will show a shortlist of these overseas people insured on your car at the time so it shouldn't be too hard to work it out from there. Why would you want to pick up a fine and points for something you didn't do?

    When did you send the paperwork off? That sounds a long time from the date you got the car. I bought car last week and had the V5 paperwork back in 3 days

    Owners of company vehicles that may have multiple drivers are expected to ensure that they have a record of who was driving a vehicle at a particular time in case of instances such as this.

    Indeed it was. It was more than "cool" - it was extremely generous. You need to get your skates on. The police have until 27th April to begin court proceedings (for speeding) and will want you nominated as driver a good bit before then. If you fail to name yourself as driver very soon you will undoubtedly face a "Failing to supply driver's details" charge. The chance of a Speed Awareness Course (the usual offer for 37 in a 30) is long gone, as is the possibility of a Fixed Penalty (£100 and 3 points). The matter will be dealt with in court and you face a fine of half a week's net income (reduced by a third if you plead guilty), a surcharge of 10% of the fine (Minimum £30), £85 costs and three points.

    All the other gumpf about V5C dates etc are academic now. The only way you can have this dealt with at minimum cost and aggravation to you is to name yourself as driver asap.

    I hope I'm wrong but I suspect the OP won't be back to answer the questions posed. I don't think it's gone quite the way he wanted it to and now people are asking awkward questions.

    You're going the right way to get 6 points and an endorsement that insurance companies load up massively for. You'll have to try harder than that to defend a failure to furnish in court. The price of failure is very high - look at costs of £620 PLUS fine and victim surcharge. People will often fail to name themselves to get off serious offences like dangerous driving or careless, so insurance companies ask why someone would think the best option is to fail to name. You won't get around the 3 points and you don't have long before they will summons you. Your best option is the 3 points + £100 fine. You won't get a better offer...

    If you are the registered keeper and you named a foreign driver you could find yourself in deep water also regrading insurance. Namely whether they were insured to drive and if not that you were permitting them to drive uninsured. £300 fixed penalty 6 points and a struggle to hire cars or any other vehicles at mainstream companies - most of which won't rent a car to someone with an insurance related endorsement.
