Have you mentioned it in your defence or witness statement? If so, you must show it. If you haven't yet submitted defence and witness statement keep your powder dry

I have not yet had to make a defence or witness statement. This was their emailed response to my LBC reply so we haven't yet got to that stage.

I would tell them that you will provide the evidence at the appropriate time as required by the court pre-action protocol (or whatever is relevant) unless they want to settle out of court.

It's what scammers do when motorists ask them for evidence.

I am sure that they will provide you with copies of the landowner contract, pics and maps of the signage and any witness statements etc that their client has to comply with your client's instructions

Ask for them to respond to your request for info first, then you will consider it, and respond in due course.

    An unexpected response from Gladstones:

"Thank you for your correspondence in relation to this matter.

Please find enclosed the evidence you requested in relation to this parking charge notice.

[Their attachments show all of the same info as the Data request, plus a map of their defined signage. They have even included signs within that map that were never even procured by EuroParkingServices]

To assist in seeking our Client's instructions we would be grateful if you could provide the video evidence you refer to in your previous email.

We trust the enclosed explains our Client’s position in relation to why the debt is outstanding and in view of the evidence itself, it is our Client's position that the sum of £160 remains outstanding within 30 days from the date of this correspondence. In the event that neither a substantive response nor payment is made within this time-frame our Client may elect to issue legal proceedings without further notice.

If after seeing the evidence you would like to make arguments as to why you believe the debt should not be owing, we invite you to return those reasons to us so that we may review them and respond accordingly. In the event a response is not substantive however, our Client may elect to issue legal proceedings without further notice.

Payment can be made by calling our payment line on 0333 0230 049 or on our website https://www.gladstonessolicitors.co.uk.

Alternatively, you can make payment via bank transfer. Our bank details are as follows"

I plan to ignore this, or respond in strength. If they weren't already rattled by the picture evidence provided of faded signage, but I think they are concerned the video will be even more damning. What would the expert opinion be please?

Claim Form received today from County court related to PCN 1 (22 Jan). Reading through it as we speak, will then read through the newbies post & other threads on here. Any quick advice as I crack on please?

What is the Issue Date on your Claim Form?

Did it come from the County Court Business Centre in Northampton, or from somewhere else?
