One other issue to explore - often car park planning permission includes the caveat that the car park is also available for use when visiting other parts of the town. Worth a call to the LA planning department to check whether any such caveat applied to this particular car park.

If you saw these clips on the UKPC web site and then
they vanished, then you need to request UKPC for
all information they hold about the incident.
If UKPC refuse or ignore you, then you issue a complaint
to the ICO and copy in the BPA and the DVLA

Next step is to contact the retailer who could well be subject
to a data breach

Does the site have notices advising of ANPR or other cameras monitoring? And get some evidence that disputes where one parking area begins and the other ends.

Carphone Warehouse. Appeal submitted yesterday, will keep you informed (it says within 35 days). I will check the LA regarding usage, and also visit the CW store to establish the signage re 1) ANPR and 2) who owns the camera that filmed the driver (and other individuals in the area at the time) that was on the website.

I amended the appeals template to add the request for any CCTV/Video/Images UKPC hold. Really appreciate all the support too.

Received a letter today, assumed it was the POPLA code. However, it appears to have been cancelled, on the basis of a slightly modified template appeal on the MSE site.

So worry over, and strangely they must have some concern over the enforceability of this. I did request copies of the video and photographs which may have been a factor.

So a big thank you again to the experts here, fantastic help, and... a result!

Did you realise that UKPC are in much trouble with the DVLA - currently banned from access. While no one is sure the precise reason, I've read one suggestion that it might be over some CCTV App they were using to film site leavers.

Might fit in with them hastily cancelling your ticket.

I am the keeper of the vehicle which you claim, received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in!ParkingEye Ltd v Beavis.!Your unremarkable and obscure signs are in small print and the [STRIKE]onerous [/STRIKE]terms are not readable.

Should you fail to cancel this PCN immediately, I require the following information with your template rejection:

1. Does your charge represent damages for breach of contract? Answer yes or no.
2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
3. Please provide!all!photographs / images / videos taken of this vehicle.

I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.

I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.

If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.

What can we say about UKPC ...

Hapless ex clamper retards and now on their second
DVLA ban, we do not see the BPA terminating UKPC
which makes the BPA a very dubious organisation and
not fit for purpose as an ATA
