Then you have until 4pm on Tuesday 7th August 2018 to file your Defence.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for the Directions Questionnaire and come back here.
thanks will do this tomorrow.

Neither the freeholder, Management Company, nor you [or your client] can[STRIKE]not[/STRIKE] therefore impose terms on my use of my parking space, other than what is in the lease. And if there were any right to do so, it could not be enforced by a third party (ie you/your client).0

I like this thread. Often the lease will be much vaguer, but this one prohibits third parties from enforcement and the definition of the parts of the development where new Estate Regs can be introduced clearly doesn't include the car parks. Plus it was the freeholder who contracted with the PPC when the lease provides that it's only the MC which can introduce new Estate Regs.
That letter won't achieve anything at this stage. Gladrags don't even read the correspondence. But it's important from a costs point of view.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. Reply from the court for the email sent:
Dear Sir
Thank you for your email. Unfortunately we cannot process it as it does not comply with the Courts email guidance
When printed out, the email and any attachments must not exceed 50 pages. A page is one side, therefore 50 pages equals 25 pieces of paper printed on both sides.
If your email does not comply with these requirements your documents will be treated as having not been filed. Further guidance on filing your response by email can be found here
it's because my lease exceeds 50 pages i think.
I have sent a hard copy via post also.0 -
You don't include anything with your Defence.
That comes later, at Witness Statement stage.
Your lease, and any other documents should be removed.
Just send your Defence as described in post #109 above.0 -

Do all cases have a hearing or the judge can make a decision based on my defence ??
