Have you spoken to a solicitor? I believe that in some circumstances it is possible to apply for probate on the basis of a copy - you would have to submit an affidavit setting out when/how the original was lost and why you believe that it was lost and not deliberately destroyed by the testator intending to revoke it (if you had the original after your dad lost capacity that part ought to be fairly easy!) I think you also have to give details of who will lose by probate being granted - i.e. anyone who would do better under an intestacy. In your case, if your dad had no surviving spouse it sounds as though the outcome would be the same under the will and under intestacy.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
