CE Enforcement fine - now asking for £140

    Hello,

    I have come home today and received a claim form from the County Court for this fine.

    I really don't know where to start in putting my appeal together as when I search the forums I can't find anyone that has had a similar issue to me.
    As stated previously a family member registered my car to stay in the car park but got a couple of letters wrong. There was no other persons in the car park with a similar index to me.
    Any advice would be much appreciated as they are now asking for £328.54

    What is the Date of Issue on your Claim Form?

    Please can you show us exactly what is in the Particulars of Claim box - redacting reg nos and name of course.

    Fed up with typing that. Why don't people just go to the NEWBIES thread first? You do have an idea what to do, the Sticky thread tells you how to win this at this stage.

    We have court claims EVERYWHERE, all the same, pretty much. And as for not being able to find all the dozens of current cases like this:
    I come home and a few days later receive a parking fine from them. After making enquiries they state that my cousin give the first two letters of my registration plate incorrectly so was not complying with their terms.
    all I can say is what were you using as your search terms, how can you not find the other threads?

    the particulars state:
    Claims for monies relating to a Parking Charge for parking in a private car park managed by the Claimant in breach of the terms + conditions. Drivers are allowed to park in accoredance with T+Cs of use. ANPR cameras and/or manual patrols are used to monitor vehicles entering + exiting the site.

    Apologies, I meant to defense.

    I have had a look at the newbie forum but I am still confused where to start. I will do as you said and try search Wrong VRN defence and see if that helps.
    This is the first time I have ever had to do anything like this and the legal system seems scary to come up against!

    The long day continues... ;)

    With a Claim Issue Date of 1st October, and having done the AoS in a timely manner, you have until 4pm on Monday 5th November 2018 to file your Defence.

    Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as described here:

    1) Print your Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.
