Iht205

Hi,

As a beneficiary of a Will can I ask for and legally expect to obtain a copy of the IHT205 which has been submitted, and when does this form need to have been submitted to the HMRC in order to establish inheritance tax requirements.

The reason I ask is that I want to be sure the estates valuation is accurate as I fear my brother (estate administrator) has devalued assets and not included gifts and content value (items of some worth over £500) - the inventory is poor) and subsequently will split the estate based on inaccurate figures and leave us all liable for further costs fighting over these points later in the day.

I would like to see what is being submitted yet despite requesting this info to the appointed solicitor and my brother they have not responded.

Any help would be appreciated.

Kind regards,

No, none of the IHT forms become public after probate has been granted.

[STRIKE]I am however puzzled, how there can be any estate to distribute when, according to your other thread, the estate is insolvent?[/STRIKE]]

Do you have to fill in the forms in order to establish inheritance tax requirements?

I thought if it was under £325k it wasn't applicable, only if it totals more than that did you have to fill them in...?

IHT 205 is required for estates under £325k if probate is required. if it’s above that then you need to fill in IHT400. IHT 400 is also requeied for smaller estates under certain conditions. The questions in IHT205 guide you on which form to use.

If probate was required they will have filled in an IHT form, probably IHT205. If probate was not required they can use pen and paper.
