usual case of invoice from Civil Enforcement ltd and now ZZPS. I am refusing to pay any additional fees other than the original £2.00 which i couldn't pay because the machine was covered with a bag which stated it was broken and to use another IF there was one available, there wasn't, added to the fact the hospital say they have policy of not ticketing cars if the machines are broken, loads of photographic evidence, no poppa reference from them etc, so in all a good defence.

My question is in regards the charges, i have stated that I will not pay unless a court tells me too as such the alleged none payment of invoice needs to go to court, now if CE ltd keep adding to the cost with letters and solicitors etc, can they claim this back if they win, its them who are profiteering by adding to the alleged bill, i have stated that it will cost £25.00 to get it into court, other costs such as demanding letters etc are not required. Can they just keep adding to the cost in this way? Thanks

    Pay them nothing unless a judge finds for them, (unlikely, judges are not fools and recognize a scam when they see one).

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned by MPs., also read this

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.

    of course they can keep[ adding charges to the bill ! they can ask for whatever they want , but GETTING IT is a different matter as they would have to convince a judge

    some costs can be recovered in court, typically around £75 in total on top of say a £100 parking invoice, so we regularly tell people a loss in court could be £175 , or less depending on the judge

    the extras they add on are not normally recoverable in the small claims court, especially if the defendant objects to them and points them out. small claims have limited costs according to the rules

    if you lost in court , the judge determines what they can have, in the judgment

    Thanks for the replies. There is NOTHING on the board next to the covered machine that states what a penalty charge could amount too, should there be an indication as to the cost of the penalty ?, it just says who enforces any penalties, of course that information could be under the plastic bag they stuck on the machine. i cannot add an image for you to see :(

    Well they are out by £2.00 which i have offered to pay (all be it late, but I couldn't at the time through no fault of my own), my original question was can they profiteer, I have been in direct communication with them, told them i want to go straight to court, which they have ignored and passed my details to zzps.

    So as long as my alleged bill if i lose shouldn't go over a couple of hundred quid then I will have my day in court. my defence is, machine not working, covered and signed with the words MACHINE FAULTY, PLEASE USE ALTERNATIVE IF AVAILABLE PARKING ATTENDANTS ARE AWARE OF THIS FAULT, no signage stating no ticket no park, no signage stating fee for breach of contract, it was a medical emergency, and the hospital policy of not ticketing cars for broken machines. i think i have a good case if it get to court.

    Well I posted on here and one another forum that a child could copy a CEL defence in crayon and still win, so no, it's not complicated to beat CEL and pre-court stuff is nothing to worry about with them.
