Arrggghhhh - looks like I'm too late with the cashback

Hi!
I have a 12 month contract with e2save.

Just as I was entering month 9s bill into quicken it dawned on me that I hadn't sent month 8s bill in.

Looking at the date on month 8 the bill was dated 12th september but the direct debit came out on the 26th September.

I'll get month 8's bill into the post first thing tomorrow, but am I knackered here?

    Impossible to know - your description is almost incomprehensible. It depends on which t&c you're on and when you got the phone. When the direct debit went out is totally irrelevant. On a deal this old the t&c should specifiy how long you have from the bill date - could be 28, 30 or 45 days. You'll have to work out from all that if it's the correct bill and too late or not. You need to be much more thorough than this if you're into cashback deals - and your one is straightforward compared to now!

    Thanks for the replies and apologies I didn't include enough detail, I was still very loudly swearing and cursing when I typed the original question in.

    I am on a 12 month contract with O2 via e2save. In order to get cashback I am supposed to submit the 6th, 8th, 10th and 12th within "30 days from the the date on the relevant airtime bill."

    I sent off the 6th bill as normal and when I was looking at the 9th bill realised I hadn't sent off the 8th bill.

    I've stuck a copy in the post this morning.

    The bill date is 12th September 2007. At the bottom of the first page it says "The amount due ... will be taken ... on or immediately after 26 September 2007"

    I expect the request to be rejected, but I have the following questions

    - How hot are E2Save on enforcing the 30 days limit?
    - Can I argue that the the date on the relevant airtime bill is in fact 26th September (the direct debit day), so I'm within the 30 days?
    - Would claims for month 10 and 12 get rejected as well (are E2Save that organised?)
    - Is threatening them with the small claims court an option claiming the 30 day window is to small? Has anyone tried this?

    In order (you still don't give your connection date or when you got your first bill though):-

    1) A) IS it 30 days or 45 on your original documentation? B) They have been know to extend to 45 days anyone on rare occasions - but I wouldn't count on it. You could call and ask quoting delays because of the postal strike rather than the real reason).

    2) Totally irrelevant as I said.

    3) Not under these t&c provided it was from E2Save and not Onestopphoneshop.

    4) I very much doubt that would work.

    This is a point I have been making for a while now. If the networks have signed up to a voluntary code which stipulates that the cashbacks should be a minimum of 60 days to claim then why are they not enforcing this on their retailers? I would think that if you did not have a claim against e2save then you possibly could against your network provider.
    Try to resolve this first with e2save and if this does not work contact Trading Standards for their take on this issue.
