Letter Before Claim - VCS
Comments

**UPDATE**
Finally received the "Claim Form" from the County Court Business Centre.
No letters from any legal representatives, just the letters I stated previously direct from VCS.0 -
If you have the claim form then you follow process which is
1. Acknowledge within 19 days from the date on the claim (and check MCOL to see it has been recorded as such)
2. Prepare a defence and send it within 33 days from the date on the claim (and check MCOL to see it has been recorded as such)
Plenty of advice prior to this on what to have in the defence. If you want the defence "checked" so to speak you'll have to post it up after 1 and before 2.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Thank you, IamEmanresu.
Just a re-cap, am I going into this with a "you can't prove I was the driver" approach? Or should I be building a defence on the fact that I've always had a permit to park my car in the "offending" location?0 -
Or should I be building a defence on the fact
I never understand why anyone would ever ask this question as
1. Putting in something that is untrue is perjury even if the other side does it all the time under the guise of "mistake".
2. A bare denial ("you can't prove I was the driver") is not a defence as it doesn't answer the particulars of the claim as this OP found out to their cost.

What do they allege and why is it untrue. Answer the particulars 1 by 1.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
randomname47, how did this case progress?0

Apologies I did not update this thread with the outcome of my case - The land owner at the time contacted VCS and came to an arrangement that involved them dropping the case against me.
My company at the time were in contract renewal talks and was brought up as a "sweetener".0 -
Good to hear this - another one bites the dust! :TPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
