Not being able to fit in a bay.

We have a pretty standard car and parked in our guest bay at home regulated by BPA. The bay’s very narrow and one wheel was just over the line, but right against the wall on the other side, so couldn’t get closer in.
They’ve given us a ticket anyhow. We weren’t limiting movement of any other cars even if the car park was full. Seems crazy to get a £100 for that.
Plan to fight it all the way, but intrigued if there are similar cases. Should we just give up?

This seems like a penalty to me and they would probably struggle in court if the width of the bay is under 2.4 metres.

This is an entirely unregulated industry which is scamming the public with inflated claims for alleged breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose, and have been reported to the regulatory authority by an M.P.
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.You never know how far you can go until you go too far.0 -
the BPA ltd, is not a regulatory authority in no way.
do you display a permit to use your own space as well?From the Plain Language Commission:

Have you read the Sticky thread for NEWBIES, and are you following the advice to appeal using the template you will find there?
What does your lease/AST say about parking? This will have primacy of contract.
Does it say anything about having to pay a third party if a car is parked slightly outside a bay?
As already said, the BPA can't and don't regulate anything. They have admitted this on many occasions.

Sorry, missed the Newbies thread, going through it now.
It was UK Parking Control.
We had displayed a permit and the photos they've taken online are pretty pointless, they don't show a great deal, certainly they don't show the line and where the wheels of the car were, just the overhang of the bumper.0 -

Nothing unusual will happen; like you will see on all other UKPC threads, you will get:
- a letter or email begging to be told who was driving (ignore)
- possibly a NTK, maybe not in time, maybe not at all...(ignore)
- a rejection letter and POPLA code will follow anyway, and you just need to then come back here and show us your draft POPLA appeal and tell us if you ever got a NTK or if you have the certain win a keeper has, when a PPC forgets the NTK by day 56!
We do want to help you again at POPLA stage so you don't miss a trick. Come back to this thread.
