Do I pay stamp duty if divorced and buying?

Hi,

I am divorcing and signing over my share of family house to ex-husband, in line with the agreed consent order issued by court.

In the meantime I am looking for a house in London.

I have read somewhere (on a few websites) that if a house purchase is due to a divorce, there is exempt from paying stamp duty. These seems to be a vague suggestion on newspaper articles etc but I can't find anything concrete to back this up.

Does anyone know if this is true? Will I need to pay stamp duty as I am purchasing due to divorce?

    Yes you will. make sure you sign over your existing house 1st or you will pay an extra 3% and have to claim it back later.
