If the lease company are BVRLA members, then read this Memorandum of Understanding that their ATA signed up to in terms of dealing with private parking charges.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

A hirer case is one where an IAS appeal is an option, especially as G24 are not litigious anyway, so why not waste their time & money dragging them to IAS and arguing the POFA para 13/14 was not followed (no hire documentation and no compliant NTH). And prove as well, that more than one driver uses this car (copy of insurance policy naming two people). IAS want all sorts of 'proof'.

IAS can only decide in favour of the PPC is the balance of probabilities is tipped to assume the hirer was also the driver. Appeal without saying which of the two was the driver, and the balance remains 50/50.

I suggest you edit your first post which basically tells everyone reading it (even the PPC) which of the two was driving. Eeek!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
