CEL PCN appeal won even though I did do it wrong.

Hi last year, just before Christmas, I overstayed my welcome in a car park where the parking regulations are many, varied and extremely confusing. I subsequently received a Parking Charge Notice. BUT the photos on the notice were blurry and there was no indication that it was even my car on the photos - DO check this thoroughly, people! AND the company, Civil Enforcement Ltd had misquoted their own parking signs on the PCN. The parking signage, although there was plenty of it, was indistinct and barely legible.

In my appeal I acknowledged the case of Beavis vs Parking Eye but also referred to the case of Cargius vs Parking Eye and, together with all the other mistakes the parking company made, my appeal was accepted and the case dismissed by POPLA. :j

The best advice I can give everyone is first of all, DO NOT PANIC. Then, read all the information on the PCN carefully. In my case, half the text was so tiny it was illegible, something else I put in my appeal. Do not pay a penny.

I have also written to DVLA asking for compensation because these PCNs really are a rip off and it's not right that they just sell our details to anyone! Fingers crossed with that one . . . :eek:

    Well done, now make life difficult for them, but do not hold your breathe, the DVLA will not compensate yo with a penny.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors..

    Parking Eye, CPM, Smart, and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.
