Just beat a PCN from Civil Enforcement

Hello everyone, I just wanted to let people know that it is possible to succeed at appeal with POPLA. I received a PCN from CEL just before Christmas and knew I wasn't going to pay it. The photos they put on the PCN didn't even look like my car and the registration number wasn't visible. I wrote to them contesting the charge, they refused to listen and directed me to POPLA. I appealed to POPLA, pointing out the photos were blurry, the notice didn't say 'Notice to Keeper', they had misquoted their own parking signage and the parking signage was also very confusing and misleading. I also mentioned the PE vs Beavis case, stating that my case was more like the PE vs. Cargius case, and demonstrated that I'd done loads of research before appealing. Even so, I was scared to death that they wouldn't dismiss the case but they did. I would not have paid anyway but would have waited to be summoned to court (gulp) where I would have produced all my evidence to prove that I'd been wrongly accused. I am now in the process of sending a complaint letter to DVLA for releasing my details because this is the third time I've been erroneously given a PCN and DVLA are making a fortune from we motorists by selling our details on. It's not fair and needs to be stopped. Having said all that, I'd just like to thank everyone on this forum who is so encouraging (I didn't ask any advice, just read lots of posts) and let others know that it can be done, please don't give up - and, most importantly, do not pay!!!:T

Well done for doing research and winning! Did you not win on 'no keeper liability' then?
There would have been no 'summons' anyway, because it's not a criminal matter.
And CEL are always beatable without a court hearing discontinue when they see a scary defence!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
