Advice needed please

Hi I left my now ex husband January 2016 had to leave quick for mine and my 4 year old son safety at the time as my ex was violent and didn’t want my son exposed to this.
We have a house in joint names which I obviously left and had to get housing with local council which I am renting and my ex is still living in the house paying the mortgage.
1. What rights do I have ?
2. What process can I go through to claim what I’m entitled too?
3. I work full time as a nurse but simply cannot afford to pay out massive solicitors bills could citizens advice help?
4. My ex earned 70-80k prior to me leaving he now has stopped paying maintenance and gone self employed so he doesn’t have to pay me as much.

I’m struggling so bad with debt and paying bills for myself and my son really appreciate any help or support please.
Thanks very much
Stephanie

It would also be worth looking at the Wikivorce website if you haven't already

You could also try contacting Women's Aid. But, unfortunately Legal Aid is just so restricted nowadays.

Also offering hugs. Its a difficult step but the right one.

I wonder if creating an SOA on the debt free wannabee board would help organise the finances a bit? Or getting some debt advice from somewhere like Stepchange.

The division of assets will happen at the point of divorce, when an order can be made for the house to be put into ex's name and you to be paid your share of equity or the house sold and proceeds split.

To force a sale outside the divorce process is long and very expensive.

IF you don't mind my asking, when were you married and when was the house purchased. Where did the deposit come from - joint savings or accumulated before marriage? Usually pre marital assets in a relatively short marriage go back to the contributor. Assets built up during the marriage in a longer union with children are split evenly or based on custody of the children. Your situation is could be somewhere in between.
