  • Very true! Think the pics do support the absolute mess of the site though even if they're lighter than it was last December.

  • Ahh looking closer that appears to be the remains of a previous company, as I assume the cctv ones are.

    The PE one is ridiculous my friend is 6ft and still wasn't small enough to read the small print t&cs. Where do they stand with a sign being to "standard" but the higher you raise it the harder it becomes to read? Such a dark area surely!

    Just to update before i go away... i have sent a SAR requested via email (using the thread provided, very helpful thank you!!) and have sent another email requesting the information i initially asked for in my first reply to them in which they didn't respond to in their FAQ sheet.

    I have had automated replies on both so wont send via post.
  • got a reply from PE today. I'll post when I get home but basically saying they're not going to tell me the grace period as that defeats the point of having one. And that the £100 still stands obviously

  • Strangely it wasn't a letter attachment as their replies usually are and it is the first bit of correspondence directly addressed to me. I'll copy and paste and I do apologise if you get any of the mad letters added.

    They're just skirting round the edges again as I asked personally for the grace period and not if it was advertised on site....

    "Thank you for your correspondence in relation to the above referenced Parking Charge.

    ParkingEye operates a grace period on all sites, that allows for the motorist to park and familiarise themselves with the terms and conditions of parking. This information is commercially sensitive and grace periods are not advertised as this would defeat the object of having one. There is a grace period at this site and it complies with the BPA Code Of Practice.

    Please note that the grace period at 13.2 of British Parking Association Code of Practice is to allow motorists to enter the car park, read the terms and conditions, and exit the car park if they do not wish to be bound by them. This is only intended for motorists that wish to leave within this grace period.

    In this instance, the vehicle remained in the car park on site exceeding the grace period and as a tariff payment was not made this was a breach of the terms and conditions. Further to this, the signage on site states that, “By parking, waiting or otherwise remaining within this private car park, you agree to comply with this Parking Contract and are authorised to park, only if you follow these terms and conditions. If you fail to comply, you accept liability to pay the fee for unauthorised parking (the "Parking Charge").”

    The signage clearly conveys that by remaining within the car park, the motorist becomes bound by the terms and conditions of parking. However, there must be a cut-off, and once this is overstayed, a Parking Charge will be issued.

    The consideration given by ParkingEye is to permit the motorist to park in the car park, subject to the terms and conditions of doing so. ParkingEye is authorised to present the terms and conditions of parking to the motorist, and to enforce these.

    The consideration given by the motorist is executory, and is to pay the Parking Charge should a breach of the terms and conditions occur. Further, there is a value in the motorist’s agreement to comply with the terms and conditions of parking as these are commercially necessary. Further, there is a tangible value to ParkingEye in the motorist’s agreement to comply with the terms and conditions of parking. If motorist’s did not agree to comply, ParkingEye’s operation onsite would be obsolete and this would result in monetary and reputational loss to ParkingEye.

    We wish to confirm that ParkingEye take the proper handling of personal data very seriously, however, we note that there is no requirement for details of our internal processes or policies to be published or provided to individuals. We would refer you to https://www.parkingeye.co.uk/privacy-policy/ for additional information on our Privacy Policy.

    We can confirm that we have now reviewed your recent correspondence but we maintain our position that the full amount of the Parking Charge remains outstanding and that we have been unable to reach an agreement in respect of the same via the Reply Form.

    We now require full payment of the outstanding sum of £100.00 within the next 14 days or legal action will be taken. Should court proceedings be issued, further costs will be incurred. These will include, but are not limited to, the court claim issue fee and the solicitors costs referred to within the LBCCC."
