Mine was different, it was a solicitors bill but they sent the bill to my old address.
I never received it so obviously didnt pay because I knew nothing of its existence.
Rather than the solicitor ring me and ask why I hadnt paid, they went to court and took out a CCJ (which was the first I heard about it)
I went to court for similar reasons as the OP (that the bill wasnt received so had no chance to sort it out/ pay it).0 -

the way it works, from what i have found out is that, if you dont renew your tax, the dvla issue what is called a late payment fee of £40 if you fail to pay this and renew your tax, they will then increase this to £80 and if you fail to pay this, they will proceed with the ccj, which will end up being £100 including court fees.
altough i had informed them at before and also at the £40 stage that i was no longer the keep as the car had been written off and scrapped by the insurance company, they proceeded with the claim, unfortunatly i didnt recieve the claim form from the court so i was issued with a default ccj.
I am have now sent off an N244 to the court asking for it to be set aside, i have no idea what will happen now, i just want it off my credit file, as i didnt do anything wrong.BARCLAY CC £360CAPITAL 1 CC £190HSBC CC £485HSBC OD £15000 -
A copy of the hearing date will be sent to both you and dvla
There is no requirement for them to attend if they dont want to defend it (the solictor I was arguing with didn't turn up to defend)
You simply go to County Court, only a small room with two people sat in (the judge plus one other)
Very informal, none of this witness box or oaths and stuff
You just go in, say hello, sit down and chat about it.
Hopefully there is enough info in the N244 but if not the Judge will ask you for some more details then make his decision.
Very simple, nothing at all to worry about. The judge in my case made his decision almost immediately.
The only hiccup may come if you are claiming costs against dvla.
You seem to be of the same attitude I was, Just get rid of the CCJ and ignore the expense.

My defence was that I hadn't received the bill because it went to the wrong address. My argument was that if I had received it, I would have paid.
I had a whole lot more as back up but didn't need it. That was all the Judge needed to make up his mind that I wasn't a waster trying to avoid paying.
Take everything though including the solicitors and insurance letters to back you up.
I cant see there being any problems.0 -
Thats correct I dont wish to pursue exspense, just want rid of the ccj, as it really unfair to have this when i havent done anything, thank you for the information, My N244 was looked at by my friends dad, a solicitor and he said its a good defense, so hopefully all goes well. Only thing that worries me is that even tough i replied to all of the dvla's letters, the court claim form didnt get to me, even tough im still at the same address, doesnt seem like a good reason to me, i mean anyone could say " I didnt get the claim form", even tough this is the truth just seems to me that it doesnt sound very good, i have however asked the court how they sent it and was told 2nd class normal post.

It was quite a while as I recall. Ironically the court claimed they didnt receive the N244 when I chased it up after not hearing anything a month after sending it!!
After I sent it a second time, I waited about a month for the hearing.
Dont worry too much about them not believing you. It is a court of law after all. They know you are commiting perjury if you lie about not receiving it, which is a very serious offence.
Just convince him you would have paid it if you had received it. Dont argue about the validity of the CCJ, that is between you and the dvla, the Judge is only concerned with you not paying it on time.0 -
I was lucky with my tax. It was while I was selling the house and I didn't recall receiving the reminder form/letter. In fact, I only "found" these about 2 months later as I'd obviously "tidied" the house quickly for a house viewing (grab everything, shove it in a plastic bag and hide it away in a corner).
Anyway, I never used my car much (2000 miles a year max) and it was in my garage out the back, I used to leave by the front door. One day I wanted to go out, went to get the car out and realised the tax disc ran out on 28/02 - and it was now 02/04.
I panicked. Ran down the Post Office. Tried to buy a new (and back dated) tax disc. Couldn't back date it. I bought a new one. Phoned up the local tax office and explained. Man said to write a letter and enclose a cheque for £X.XX (he told me how much). I sent it off. End of episode. Thank goodness!0 -
Thanks for the help guys, first time i've been involved with the court for anything, its quite daunting, but hoping things will go my way as i didnt do anything wrong at the end of the day. Wish i had applied for this before october as it would have cost me £65 insted of the new £75 charge!

Theres plenty of 2 beds around the area for the 100k mark
Some areas maybe even 3 beds
Depends what your after really
Eyres Monsell your talking that now for a 2 bed maybe even a 3 if your lucky the same with some areas of Beaumonet Leys and Stocking Farm
Take a word of advice about buying in these areas mainly being x council
A lot of these houses are made form laing easy construction and not all lenders will lend of these types of houses.
If it is a laing easy house your planning on buying please make this clear to your IFA.
We didnt know about construction issues and got turned down several times when we were FTB simply cause how the houses were made of the Estates.
