Help with ParkingEye PCN false parking

Hi All,
I have read the newbies faq and I really need help with a false parking claim in Morrison's Car Park by ParkingEye.
A family friend borrowed our car and took her daughter who was learning to drive through the car park 2 days in a row in January 2018. Few weeks later I received a PCN with photos alleging that the car entered the car park at 3:26pm on the first day and left at 13:13pm the following day - a total of 21 hours 47 minutes. The photo on entry first day was very clear but the photo of the car exiting on the second day was well doggy, you can barely read the number plate. What is worrying is that whenever the friend takes the car for driving lessons, they leave their big car in our driveway and take our small car, returning after about 2hrs. Our car is always parked in our driveway so I am confused how ParkingEye managed to produce what is clearly false photographs of events over the two days.
I have appealed on their website telling them the above without naming who was driving but they've just responded by saying "we will require evidence confirming you were not on site for the time as stated on the Parking Charge Notice". I thought if I can find CCTV footage from neighbours that should be ok but considering this is a long time ago, this is virtually impossible.

I am about to send ParkingEye the BLUE TEXT template and take it from there. I would just like to know what my options are. Any advice will be much appreciated.

    this is known as double dipping , so search for it on here and parking pranksters website

    and yes use that template appeal as KEEPER, then after that appeal to popla, as the NEWBIES FAQ thread tells you to do

  • Hello again, I know you are not suppose to reveal who is driving but can someone tell me if the following first reply to PE before I found out about this forum broke that code? In it I said
    "We took a girl who was learning to drive through the car park on both days and we decided not to purchase anything and this is not an offence last time I checked.
    At all times there were at least two people in the car while inside the car park
    I think you camera has shown the time of entry on the 23rd of January and the time of exit on the 24th of January and for some reason did not show the car leaving the car park on the 23rd of January 2018"

    It's not a "code" as such just advice, but all you said was "a girl" how could anyone know or find out who "a girl" is unless you tell them?

    Dear morrisons....
    I am writing to you as the registered keeper of vehicle (reg number) on (date) a short visit was made to your (location) Store.
    on (date) a second visit was made to your store, however your agents, parking eye are alleging that my vehicle remained in your car park for over 21 hours.
    First of all, the use of ANPR cameras is prohibited in local authority car parks, partially due to the inaccuracies inherent in these systems ( ie failing to correctly record in/outs)

    Your agents, Parking eye have clearly failed to provide reasonable care in their activities as it would appear that their is no manual monitoring of the camera systems, and my details were wrongfully requested from the DVLA which has resulted in a series of intimidating letters sent to myself which has caused a great deal of stress, and worry and has in turn consumed a vast amount of my own personal time in dealing with this.
    This in itself would be a clear breach of the Data protection act.

    I would at this point like to remind you that you are jointly and severally liable for the actions of your agents, and I am now insisting that you take the following actions:
    1: immediate cancellation of any parking charge notice issued to myself, together with a full and underacted apology
    2: the immediate removal/disabling of any automatic number plate system in place in your car parks, until such a time you can offer a guarantee, backed up with evidence that such systems will be manualy monitored at all times by a trained member of staff to avoid any future incidents.

    As a gesture of goodwill, I am willing to forgo any claim for my time spent in dealing with this, however the issue of the data protection breach still remains un resolved

    A compliant on this matter will be passed to the Information Commissioners office (ICO )

    Morrisons will cancel with a complaint to the CEO. I've never seen them turn one down. Just do a forum search on 'Morrisons ParkingEye' and read many from the past few months - all end the same way, charge cancelled!

    It would still be worth pushing them on the double dip incident, that they had no business in accessing/using/processing your personal details, and due to their lack of due care and attention a situation has arisen that has caused a great deal of stress/worry and used a significant amount of time in trying to deal with it.

    Appeal to PE telling them their ANPR has missed the 1st exit and 2nd entry.

    Point out that a stay of that time is ludicrous.

    You will see from the second that the charge was cancelled after lots of newspaper exposure. Think????

    But do not mention anything about girl, who was driving. Instead, talk about "the car" entering twice.
