Privately sold vehicle, new owner claims fault

    He's trying it on dont answer and call or texts block the number

    I had a chap ring me about a car i was selling and wanted to pay full price and send his transporter to pick the car up sounded dodgy so i told him no thanks

    (There has actually been cases sellers have reported on here over the years where they as the seller have actually lost in court having sold knackered vehicles. So it's certainly not as straight cut as people would have you believe.)


    A case I believe not cases, sold a vehicle with a Gear Box issue that was mentioned prior to issue and the seller went ahead then sued.


    It was also a lower court and does not represent case law I believe, it is though a valid warning so I am not critisciing you for bringing it up.

    Your description of the van is very comprehensive. I have an idea that the buyer has experienced a financial problem or has some other reason for deciding that the van is not what he needs. If he continues to harrass you about it, write him a letter stating that the van was in good working order on the day he bought it and there is no legal reason why you should be responsible for repairs. If he threatens court action, ignore it but keep all emails and letters from him.

    When I was in the trade, (20+ years a workshop foreman) I came across several cases of buyers 'trying it on'. Not one was successful.
    I think this job really needs
    a much bigger hammer.

    Head gaskets rarely just fail. And more often than not They fail because of a different fault like a faulty thermostat which is easily detected by the driver with the engine temp gauge.
    They show signs of failure any normal person will spot. Mainly you'd be topping up your coolant regularly and/or see discoloration.
    I've seen cars have failing HGs from several months and still being driven around until they finally become undrivable.

    And at this point people often get rid pretty quickly whilst the vehicles still running and can fetch a lot more than scrap value.

    So as I said before imo somebody is pulling a fast one, may well be the buyer. But can just as easily be the op. As said it's a common thing people do nowadays when they know there's upcoming repairs due.

    Yet another private buyer who thinks the vehicle comes with a warranty..... i!!!8217;d just ignore him.

    He should have carried out a more thorough inspection before buying. It!!!8217;s his van now and his problem.
  • The vehicle is 18 years old. No-one can warrant that the head gasket (or any other part of the vehicle) will not fail.

    As many others have said, it's a case of buyer beware. The buyer cannot make a claim against you.

    Many new cars don't have one. My new Dacia Sandero Stepway doesn't. Neither does it have a CD player. But 18 year old's should have one.

    I'm not sure whether this is a good thing or not. I'll let you know in a few years time.
