Hey,

Right I need your opinion guys and gals to see if I'm the stupid one or if the letters below are not detailed enough/confusing. I'll start from the beginning.

In 2016 i bought a house with my partner at the time, she had access to my Visa card as i earned more than her at the time so i was paying with the bills but she was the one who would sort it all out (i.e pay for them using my card). We are no longer together and everythign has been transfered to my name (house, land, bills etc..) where as before it was in both our names.

I get a letter from Property Debt Collection Ltd asking for £441.13 on behalf of the company that i pay the land rent and service charges to. I ask myself why am i getting this as I've not had any letters asking for the payment. I spoke with the company i pay the land rent and services charges to about this via their live chat, i then actually find a letter dated 8th May 2017 asking for 1st July Half Year Service Charge. I didnt pay it there and then and thought id pay it when my ground rent is due, so it came to August and it was due, my ground rent is £125 every 6 months and my service charge is £85.36 a month. In august i logged into my RMG Living account and made a payment of £350 via my debit card exactly so that it covers both the ground rent and the service charges and also some for when its next due.

The guy on Live Chat then tells me that the Ground Rent and Service Charge are 2 different accounts, i said to them i didnt know about this and there was nothing on the letters telling me they are different accounts. He said because payment was made previously i must have known, i told him that my ex was the one who made the payments using my card. He said because the payment was made using my card there was nothing he could do. I start arguing with him saying he can clearly see that my ex was removed from the ground rent etc... and that he can clearly see i made the payment but just under the 1 account as i didnt know about the 2 accounts. The guy who i spoke to is actually part of their complaints team as it was them i selected to speak to in the Live Chat. He wouldnt do anything for me and says that they are 2 different letters, so im looking at the letters and they dont look like 2 different letters at all with no where stating they are 2 different accounts when making the payment. Oh and they said they have sent me letters but ive not had anything, then he tells me they switched from letters to email, so i checked my email and i find an email from Feb 2018 asking for payment, but that email was in my Junk folder so i never saw it. I then asked him when did i agree to this? He said i didnt, it was a company decision. I dont know why they couldnt just call me if they wasnt getting a response from me. They have my details so why wouldnt they call me? Both the letters say they come from the same company.

Anyway im still arguing my case with them as theres no way im paying all the extra fees they have added on top even though by my books I paid what they was asking for but didnt know they are different accounts. Property Debt Collection Ltd have added £160 on the bill just for them to send me a letter. The management company have also added fees such as a £80 Admin Fee aswell as £34 reminder fees. Not sure what reminders they sent except that 1 email i have from them which was in my junk/spam folder.

Anyway take a look at these 2 letters, if you got these would YOU think i have to make the payment for them in 2 separate accounts? Can you see anywhere on the letters that says i need to make the payment into 2 different accounts?

Please vote above and let me know your thoughts, as far as i was aware i paid, but they are having none of it.

EDIT: Just as a note this is my first ever house so based off if you didnt know how everything works would you have done the same thing?

    So, cutting out all the excess, you received that - and ignored it. Now they've passed it to debt collection, and you think that's terribly unfair. You may have missed some emails because of not checking your spam folder. There may or may not be some chinese whispers about the payment destinations.

    Next time, set the damn DD up.

  • You've only posted the invoice for the service charge. Where is the one for the ground rent?

    They look like two different letters to me.

    The giveaway for me is ones give payment details, the other for the most part requests the you contact them regarding payment details (barring online and cheque)

    You assumed something that wasnt the case.

    Yes i did read your post. You havent paid both of the bills. You paid an amount to one account. The assumption anyone would infer from that is that you are wishing to over pay on that account not that the payment was for something else.

    Ive got to pay HMRC to 3 separate accounts regarding tax. If i pay it all to one they dont apportion it for me, they send me a fine for not paying the other two.

    Why are you running a poll on this? How will a poll help you?

    I would have thought you would want advice on the law - i.e. whether the law requires you to pay these fees.

    And if the law doesn't require you to pay these fees, how you can move forward with the mgmt company.

    The one that doesn't mention bank transfer at all, but says online payment is via card?

    You paid that one by bank transfer, assuming that the account on the other one was the right one?

    Presumably the detail is on the other side? What you have posted does not show an amount.

    But they both say payment can be made online (on the back of the letters), which is what i did when i logged into my RMG account. I logged in and makde a payment of £350. On the back of each letter it asks me to login to my RMG account to make payment which is what i did.
