bought a car then it broke

hey all.

i bought a just over 3 year old bmw 118d with 20k on the clock from a car supermarket on finance.

It broke down 6 hours later. a problem with the brakes.

the car is currently in a bmw independent specialist as the supermarket wanted someone more qualified to fix it. This happened 2 weeks on saturday (10/02/18)

The car is still in the garage where they are changing various brake parts including abs pump callipers and disks/pads.

phones the repair garage this morning at 9.30 am to get an update. told they are waiting on the supermarket to give them a purchase order to authorize them to do the work because of the large cost. spoke to the supermarket today at 3.30 pm and was told they are waiting on a director to sign off on this. (a whole day to do that? i thought)

tomorrow when i phone them i am in 2 minds on what do. if the car is ready by the end of play tomorrow then fair enough however in my head, maybe im being paranoid but i don't believe the problem will be fixed and it will likely happen again. or if we are no further forward then i am ready to go further.

What i am asking is for opinions on what you would do and what my rights are legally. thanks

    Directors are notoriously hard to pin down, one day isnt that unusual.

    Maybe you are being paranoid, wait until you get the vehicle back.
  • i was traveling down the motorway doing about 70mph and the brakes came on by themselves, took me down to about 30 mph before releasing.

    this happend a second time before i was able to get off the motorway, by the time i did the callipers were stuck on and binding to disks with smoke bellowing out the front wheels.

    the AA came out and towed me home as the brakes just wouldn't let go.

    i hear what your are saying and i hope it is just paranoia but to me the garage doesn't know what caused the issue and just changing out parts for sake of it. the garage have told me that they cant replicate the fault.

    Strange as unless the vehicle has AEB, I can't see how/why the brakes would just apply themselves, but still as before,wait until you get the car back.
  • that's what is very strange. the car doesn't have anything like that. no cruise control or active radar etc.

    the only thing i can think of is i was in eco mode and i read somewhere that the efficient dynamics system occasionally cleans the disks by applying the brakes but not to that extent.

    Where did you read that?
  • if you google bmw dry brake there is a youtube video. i cant link as a new user.
  • I'd be inclined to reject the car - it is within thity days of purchase - on the grounds it has a significant fault that was present when you bought it, under the Consumer Rights Act 2015. There may be a small deduction for use of the car.

    Also complain to the company financing the car, if you haven't already done so.

    i had to laugh at this. i had the car all of 6 hours, it has been in the garage for 2 weeks. if there was any deductions then they can take it out the full tank of diesel that i put in it. :D
