Maybe if you did a Statement of Affairs on here we may be able to help you with a budget so that you can afford to pay them back over the year. It seems it is the lesser of 2 evils

As the OP says that they have already done a Statement of Affairs with HMRC, I suspect that HMRC may have identified areas where the OP could reduce their spending so may have based their calculation on that.

Not sure why the OP is reluctant to share that SoA on here in order to get some advice on reducing their outgoings. Hopefully, it's not because they could make savings but prefer not to have to.

Anyway, I fear the upshot of it will be that unless the OP can come to an arrangement to pay a sufficient amount per month to HMRC, they may well amend the OP's husband's tax code (or something similar) to claw the money back.

    Have a read:
    http://taxaid.org.uk/guides/taxpayers/tax-debt/enforcement-action
that details the actions that HMRC can take to recover a debt.

    Thank you for your reply.

I am not wanting to disclose personal information as my husband doesn't want me to discuss our finances on a public forum, which I respect. Nothing to hide at all.

Hopefully we can come to some kind of agreement with HMRC soon.

I struggle to believe that you have no assets. No car, no mobile phones, no spare clothes, no television, no jewellery?

    How is this possible?

Edited to add, I just had a look at other posts. You have a house which you own, you had Sky television back then, an iPhone, a car etc. have these things all gone, including the house and television?

Thank you for doing your research.

Yes I still have my home, should I sell that? Up sticks and move with 3 chronic illnesses, with what support? I am bed ridden a lot of the time so moving house to pay a 3k debt is just not do able. That may be difficult to understand if you've not been in that situation yourself but some days I struggle to walk to the bathroom, let alone pack a house up and move.

My husband uses my car which I no longer drive due to ill health, so that he can get to and from work. So yes we do have 1 car.

    Sky television is indeed gone.

I have a phone, an old iphone which is paid off and worth very little.

1 television in the house which would bring less than £100 in and with 3 children, no I won't sell that.

I have clothes but with ill health no energy to list them to sell and the clothes I have I need. Should I be expected to sit naked all day or in pyjamas?

Jewellery I have nothing worth a lot at all, just my wedding ring and engagement, am I expected to part with them too? I think not.

I may remove my original post as I find people here who ask for genuine advice get attacked, which in my circumstances is not needed.

    Thanks again.

You could get advice from one of the free debt advisors like https://www.nationaldebtline.org - that would be private.

We are worried they will juset change his tax code and take a lump sum each month that will leave us in a mess. Can they do this?
Yes, they can do that and most likely will, so be prepared for it. Hopefully you will be entitled to PIP and this could make the difference.

So you have things that you could sell, but won’t, and will just not pay the state back for the money you took when not entitled to it then?

This is not attacking you, I’m just appalled at the priorities that some people have nowadays.

What are you seeing where the OP says they have items they can sell but won't?

A sense of entitlement, mainly. Why, what do you see?
