  • zagubov beat me to it. £85 is cheaper (and less painful) than having your car written off by the lorry coming through on green.
    Or the even worse possibility, ploughing into a car side on and severely injuring or killing one or more of the occupants.

    Just be glad that no one was coming the other way; things would be much worse if you hit someone who had a green light.

    Indeed why.
    You would be foolish in the extreme to take this matter to court.

    I was simply demonstrating that even with a guilty plea a court hearing will cost a considerable amount more than the FP. A guilty plea (with the near certainty of a conviction) will see the fine increase by 50% and the costs by up to £500.
    But prior to replying to the 172 you can ask for photos to identify the driver. Advice often given out on Pepipoo.

    Indeed you can. There is no obligation for them to be provided, though they nearly always are. However they rarely provide any meaningful assistance in identifying the driver.

    My issue with NoPenaltyPoints is that the advice it gives is at best misleading and at worst can see the driver facing a far more serious charge and penalty than he needs to. In this particular instance their advice to consider not returning the S172 notice simply on the basis that you cannot identify the driver from the photographs.

    If the photographic evidence is inconclusive it is debatable whether or not you should sign the NIP, as it is effectively an admission of guilt and could potentially be brought up against you as such if the case goes to court..

    It then goes on to say that all you need to do is to simply write a letter saying you’ve done all you can to identify the driver (i.e. looked at some inconclusive photographs) and that’s that – a Magistrate would be very hard pushed to convict you. There is far too much wrong with their advice overall to be covered here but it is utterly irresponsible to publish much of it.

    Don't go taking the easy choice.

    Your best bet is to post on Peppipoo forum, but to be honest I'd consider choice 3 given the fact you have at least if not more of a 50% chance of them pulling the case.

    I heard of one a few months ago, got a offer of 3 points etc but optd for the court hearing.

    First hearing date wasn't suitable to the client, they asked for a new date - granted.

    The day of the hearing, the prosecution pulled the case and offered no evidence.

    1. What makes you think the case will be pulled?

    2. In the likely event that it goes ahead, what defence do you think the OP should offer, bearing in mind that he is guilty?

    Basically, ask yourself a couple of questions. You were on the road, you saw the flash so you know that they've got a picture of your car. The only possible defence really is you were in a (genuine, someone is actually about to die) life or death situation.

    Option 1 will cost you a bit but you'll probably get some free tea and biscuits. Option 2 will cost you a bit more and get you some points. Option 3 will involve you going to court (and because you won't be banned, they'll go ahead without you and find you guilty so that "tip" from theone is rubbish) and asked to explain why you ran the red light. They'll listen patiently, dismiss whatever you come up with, and then you'll end up shelling out about £620 and get the points. Your choice.

    The advice you will receive on Pepipoo is the same as the majority of the advice you have received here. On your own admission you are guilty and there is certain to be evidence to convict you.
