Ccj at my name, wrong address

A Claims form is issued, if you do not respond by 14 days from the served date the parking company can request a default judgement, they do the defaults en-mass so you won't be told a hearing date as you have not responded to the claims form. If you do respond and dispute then you can get a hearing.
You have been given options, the advice is to get own legal advice. If they have a name and wrong address, no DOB, then CCJ will be on the public register and may not be associated to you if you don't have any connection to the address. If the CCJ goes unpaid, bailiffs may be involved. It depends how you friend feels about getting lots of letters and potentially a knock on the door from a bailiff. Would they provide your details to them then? Would they remain friends?0 -
thank you Susie
Actually i am out of country and won't be back before april.
i have read about the claimant LEC normally do not turn up in the court.
should i notify the court about the claim received and my situation or should i quietly wait and see.
what do you recommend
regards
Hi again jony
Apologies, I think I may have misunderstood your original post as I thought a CCJ had already been made. If it is court papers you have received you have the opportunity to admit the claim and make an offer of payment, or enter a defence. If you want to do this you should contact the court and explain you are currently out of the country.
If you admit the debt or ignore it a CCJ will be made. And as nic_c says, a court hearing is only held if you enter a defence. I would recommend seeking legal advice if you are considering defending the claim as you can incur further costs if not successful. You can find more information on responding here https://www.nationaldebtline.org/EW/factsheets/Pages/replyingtoacountycourtclaim/replyingtoaccj.aspx.

Great point, I am thinking the same thing. I hope my friend will not betray me if ever bailiff turns up. I think the parking company will not send bailiff for £3500
