  • Hi All, Just dragging this back to life, first apologies I did not reply to the last message.

    I've had a court letter through so i'll be revisiting the guides and fighting it...... wish me luck

    I will defiantly post progress and follow up on this thread.

    Only just seen this one and wondering what happened in the very long interval between now and the heinous crime .... did you complain to the car wash? I recall a similar set-up in Shrewsbury, can't imagine the car wash outfit doing anything other than frenetically washing cars and would have thought a complaint needed to go to the overall landowner.

    If you've let this ride in the hope it'll go away, now is the time to get busy addressing this court letter etc.
    But although that's clearly the priority, if there is time also investigate whether the landowner will do the right thing and cancel the charge. While it's very late for a landowner cancellation, the absurdity of the situation might make it worth trying.

    I have the claim form and the date of issue is 18/12/2019

    Unfortunately I couldn't find the land owners information, the Shopping Centre Manager refused to give it to me over the phone and said I need to email in, I did so via the contact page for shopping centre I took a screen shot the second time. I never got a reply.

    The shopping centre is in Gravesend In Kent.

    Raven Meadows. That's going back 3 years though. They used to leave the cars in ground floor parking spaces once done. Never questioned it at the time, I would now!

    I have the claim form and the date of issue is 18/12/2019.
    With a Claim Issue Date of 18th December, you have until Monday 6th January to file an Acknowledgment of Service. If possible, do not file an AoS before 24th December, but otherwise there is nothing to be gained by delaying it. To file an AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having filed an AoS, you have until 4pm on Monday 20th January 2020 to file your Defence.

    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Mine was in the car wash for around 32 minutes, I dropped it, went to get a coffee and come back just as they where finished.

    The car was never parked in a normal space and the centre manager confirmed that space was rented by the car wash people. He said I should have bought a parking ticket but then admitted the signage wasn't clear.

  • I've submitted my AOS now, I will start putting together my evidence next week.

    If anybody has defended as a similar car park car wash any info would be helpful. Thanks
