Hi everyone just a quick question
I am dealing with a claim from excel parking through BW Legal for my Daughter who is now working in another country to cut a long story short
It's at the agreeing an appointment for mediation to call stage
My Question relates to the fact there was a valid ticket bought at the time of the issuing of the parking ticket
my daughter spoke to the parking attendant at the time and showed her the ticket it was dark the ticket had fell onto her seat the attendant said she can't stop issuing it as she had already started the process but she took a photograph and said she would get it cancelled and advised my daughter to take a photo also on her phone as well just in case she got any letters etc
In the meantime my daughter moved to another country to work less than 2 weeks later
She has since lost the original ticket but has got the picture of the ticket which she has sent to me
Will this be acceptable as evidence for the mediation or court if it gets that far

I would say yes, its always a good idea to photograph these receipts no matter what they are for , including paying for parking
evidence is evidence , after all, and the metadata will show it was taken on the day in question , plus her statement of truth in filing the evidence
people use photos all the time for issues like signage and suchlike0 -

nobody can tell you or her if it will get as far as the judge until the usher calls the case in the waiting room in the local county court
they could decide to cancel at the last minute, or before
but the lamilad cases went to court , so as excel themselves are taking this one maybe they will go before a judge, perhaps Jake Burgess himself will deal with it0 -

Hi with ref to the above The mediation was cancelled as no slot available was then sent a letter from the court offering mediation again but had to reply within 7 days unfortunately didn't get it till I got back from holiday so was too late to apply
Court case is now early July
BW are sending letters offering reduction on cost from £240+ to £150+ without prejudice and have even sent me photographs of the veh and the ticket which wasn't displayed held in their hand the warden apparently said it was in the persons bag
Who buys a ticket and puts it in a bag its laughable
Well wife has spoken to Citizens advice on the phone and is dropping in next week
Do you think I'll be ok going to court it's a matter of principle now I was inclined to offer a nominal sum and see what they came back with0 -
strange how BW LEGAL are now involved when EXCEL actually dealt with it earlier
I cannot see CA being of any help whatsoever as they know nothing about private parking matters
I would stick it out , win or lose , see who blinks first
just make sure the evidence is put in and WS is done and the costs order for your side (if you win) are also sorted out in good time , usually say 2 weeks before

Don't waste your time with CAB. They do not understand the Private Parking industry and will recommend paying.
Mediation would've not worked either.
Who is the named Defendant here? You or your daughter?
Offering anything less than the claim value will be seen as a sign of weakness and they will refuse with the idea that it'll be easy to get the full amount from you - with or without the court's help.0 -

It's my daughter but she has worked and lived in China approx 10 days from when the ticket was issued
The thing is if the Traffic Warden had said at the time you are liable sorry then she would have paid it but she specifically told her don't worry it will be cancelled that's why she took a photo of the ticket and just in case got my daughter to as well !!!128557;!!!128557;0 -
As your daughter is the Defendant, you have a bit of a problem.
Wait for others to suggest how this might be overcome.

Wardens look after things. You are giving this person more credit that she deserves.0
