Parking Eye - PCN - Aldi - Lease Vehicle

Good Afternoon All,
My employer has received a PCN from Parking Eye that has been forwarded from our Lease Company for my vehicle being parked on an Aldi Car Park for 20 minutes over the 90 minute time allowed on 10th Feb 2018 and the date of the letter is 15th Feb 2018. Our lease company have made representation to Parking Eye advising them that the vehicle is in my employers possession. I presume Parking Eye will now re-address and re-date the PCN and my employer will then pass on to me? I have read a few threads but to be honest without sounding ignorant I find them rather confusing. I would be very grateful for any advice on what to do with this notice if anything at all?
Thank You
Chris30381

Start by reading the Newbies Sticky at the top of this forum - it explains everything and lays out what to do now.0

Sorry I should have been more specific, I have read through the Newbies Sticky and the threads about Leased Vehicles but I am still unsure how to go about this notice as there are different answers and explanations and none to my specific situation.
So my questions are?
Should I wait for Parking Eye to send my employer a new PCN or not as the Lease Company have made representation to Parking Eye advising them that the vehicle is in my employers possession?
Or should I just appeal online to Parking Eye and attach a copy of this letter?
Dear Sir/Madam
Re: PCN No.
I challenge this 'PCN' as lessee of the car and subsequently request all future correspondence be sent directly to myself at the address listed below:
My Employers Company Name
My Employers Street
My Employers Town
My Employers Postcode
I am the vehicle's hirer and keeper for the purpose of the corresponding definitions under Schedule 4 of the Protection of Freedoms Act 2012 (POFA) now it is proven that in this instance, the registered keeper is not the "keeper" (as defined under POFA), ParkingEye Ltd has no reason to contact ALD Automotive Ltd again regarding this PCN
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either offer me a POPLA code or cancel the charge.
Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.
Yours faithfully,
My name

If there is any risk of your employer paying this invoice and then deducting money from your pay, I would be sending that letter now.0

Thanks for your reply, is the letter fine to send as it is?0

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.
Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (who take hundreds of these cases to court, and nearly always lose), who have also been reported to the regulatory authority.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas. You never know how far you can go until you go too far.0 -
I would use my home address.Chris30381 wrote: »Thanks for your reply, is the letter fine to send as it is?
But otherwise ok.
Have you complained to Aldi?
Did you see this in post #1 of the NEWBIES thread:ALL CASES - COMPLAIN FIRST, ESPECIALLY OVER A RETAIL, HOTEL, OR HOSPITAL CAR PARK:
Always complain to the Retailer very quickly and assertively, WITH A RECEIPT IF POSSIBLE:
Successful complaints about private parking tickets - how to get them cancelled! <<< CLICK
See how easy it can be to get these cancelled by a retailer/hotel/landowner. VERY EFFECTIVE AND DAMAGES THE PPC!

The reason I am not using my home address is that the car is leased to my employer even though I drive the car. The car is not leased to me personally. Should I still use my own address?
No I haven't complained to Aldi as I don't have a receipt or statement as we paid cash, I presume they will just inform me to pay it as I don't have proof..0 -
But you are the day to day keeper, and if they take further action, e.g. court action, you will be the defendant not your employer.Chris30381 wrote: »The reason I am not using my home address is that the car is leased to my employer even though I drive the car. I don't know whether it matters, but leave it overnight when perhaps someone will give us a definitive answer.0 -
Very true..
Thank You for your reply0 -
Just to throw a spanner in the works, I would have waited for the above to arrive, then appeal, as long as you know your employer will NOT pay it but will let you appeal is as lessee.Should I wait for Parking Eye to send my employer a new PCN or not as the Lease Company have made representation to Parking Eye advising them that the vehicle is in my employers possession?
And when you say 'letter' you don't mean snail mail to the black hole at PE, I hope!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
