Sorry but I!!!8217;m completely rubbish at this stuff, how do I find out who the creditor is? What is bmpa?
I don!!!8217;t want to go through court etc. I!!!8217;m not in a position to be able to do that at the moment.

I appreciate all the help I!!!8217;ve received from this forum but I think I am just going to pay and learn my lesson. I thought I may be able to try appeal Popla a decision but have just read that I can!!!8217;t. This has completely drained me (apologies if that sounds melodramatic - I am struggling these last few weeks and every little thing just feels like another massive blow) and I just can!!!8217;t keep on with the stress of it all.

Where is the stress in ignoring any junk mail from debt collectors - you must get other junk mail you ignore!

See #2 in the Newbies faq to learn about the BMPA.

(The creditor is the firm saying you owe them money!)

The junk mail would not go to me. And the person it would go to would very much so be stressed despite my explanations. And I am exhausted I just don!!!8217;t think I can have this potentially hanging over me for 6 years.
I know some people ignore he junk mail and end up having to attend court and I just feel that I would end up having to do a lot more than ignore the letters

The creditor is the parking company - Gemini Parking Solutions.

BMPA - stick in google to find out.

BMPA are mentioned in the NEWBIES thread - you found that in December.

The NEWBIES thread suggests you google BMPA GEMINI PARKING SOLUTIONS.

    Try it.

    Thanks Keith.

Yes I found the newbie thread in December but I didn!!!8217;t remember the bit you posted. And didn!!!8217;t remember to go and check it. Sorry.

I have googled what you suggested.
They have had 27 court hearings in 2018 so far... so I think I!!!8217;m going to cut my losses here and pay the fine. I am
Not willing or able to go through a court hearing.

So when you read that BMPA page you saw this:
Their decision to issue a claim is a commercial one - so ask the reason why they think you are a soft touch. Have you given information they needed; or did you admit to something without checking; or more likely, are you on their mug's list. To get them to drop the claim, make it uneconomical for them to continue.
Are you on their mugs list?

With a rather dodgy POPLA win when two identical cases have been lost, I doubt they'll be rushing to cough up ~£250-£300 to conduct a court case against you to chance recovering £100.

No guarantees in this game (and the game could be significantly changed to the advantage of the motorist once the Sir Greg Knight's Bill goes through), but they must have more lucrative cases (multiple tickets) to pursue.

Now isn't the time to supinely reach for your purse and hand over your hard earned. If they do pursue to court, you can settle at any point up to the courtroom door.

There are interesting times ahead, so I'd bide my time.

But, as always, up to you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Keith you clearly believe I am, and that!!!8217;s fine.
I may well be a mug for considering to pay up, but a dying family member and another who is recovering much too slowly from a serious op changes your perspective on things!
All debt collector letters/court letters etc will go to the person who is the registered keeper of the car, who is disabled, suffering from multiple mental health illnesses and recovering from a big op. She will see all these letters and the stress I imagine will not aid her recovery. So I am considering paying out for peace of mind for both of us (as I am finding life quite difficult at the moment and this is just an added stress!) If that puts me on the mugs list then fine.

    Umkomaas I see what you!!!8217;re saying. I!!!8217;m
Leaning more towards just paying to be done with it at the moment, for reasons above. I do appreciate your advice.
I will probably step away from making any decisions for a week or so and come
Back to it when I am hopefully not so stressed out.

    Not at all.

I'm just repeating a question the BMPA suggested you ask yourself.
