  • Unfortunately, the rule is that you should not cause any traffic on the main road to slow or deviate when entering from a minor road. While excessive speed may be a mitigating factor (prove it though!) the argument is that the other car is allowed to be on the wrong side of the road to pass obstacles, so you have to give consideration that it may be "established" in its position, hence it is not clear cut simply by saying they are in the wrong.

    Interestingly, if there are cars parked too close to the junction, they could be considered to blame in part - 10 metres (2 car lengths roughly) is the rule.

    I had a similar issue to this years ago.
    Bumped into someone at very low speed (my fault) however no visible damage to the car at all. Took lots of HD videos and up close pictures of their rear bumper and informed my insurance company.

    They advised they would contact me for the images should any claim arise.

    A claim did arise and i didn't find out until my renewal and discovered they had paid out as well.
    WHen i had advised of the photos and videos they shrugged it off and it appears because it's cheaper for them to pay out for non existent faults than risk a personal injury claim and / or the possibility of dragging it out longer.

    They claimed £500 for a rear bumper respray and £1000 hire car charges.

    My fault for bumping into them but annoying them claimed for damage that wasn't there.

    They got dealt with my insurer directly, rather than go through theirs funny enough.

    I read your description as you are turning left from a side road onto major road. You are looking mainly to your right for a gap whilst edging forward to see around parked cars. As you have edged out you have come into contact with a car coming from your left.

    You state the other car was speeding because he came out of nowhere. Cars do not come out of nowhere they are simply not noticed until it is too late. As you did not see the other car prior to impact you have no way to say what speed he was doing. Your report of no damage also suggests he was not speeding.

    I suspect there were parked cars on both sides of the main road which would account for the other car being in the centre of the road.

    In terms of liability you have a duty to give way to traffic on the main road you are joining even if they are on the wrong side of the road. This will be a fault claim. The lesson to take away from it is more observations in both directions before joining a main road.

    In terms of the damage to the other car post up the photos so we can give an opinion.

    Get this reported to your insurer asap and let them deal with the other party.

    If you DONT report it your insurance will be void for non-disclosure and miss-reporting of risk.


    If he ends up contacting your insurers then you'll be cancelled too which will hit you a lot harder than reporting an accident.
