Emirates (airline) dispute EU-reg 261

Last summer (June 3rd 2017) we were scheduled to fly from BHX to Auckland, via Dubai then Melbourne. Owing to technical difficulties; we were unable to fly, and we were delayed by 24 hours. We had a WHOLE HOST of problems, relating to getting accommodation for the night, and getting ourselves booked on to the following evening's flight.

Emirates most recent response follows :

"[FONT=&quot]You may be aware Court of Appeal’s ruling in relation to the application of EC261 on our flights from the UK involving a stopover in Dubai, Emirates are currently awaiting to hear from the Supreme Court who we have asked to look into this matter further. Once this has been finalised, depending upon that outcome, you can resend your claim for further review."

Are they entitled to take this position?
