Car Purchase Evans Halshaw

I recently purchased a pre reg Vauxhall Viva from Evans Halshaw Nottingham. When i went to test drive it had 125 miles on it.So i rang later that day and paid my deposit and arranged to collect in 2 weeks time.When i went to collect the vehicle it now had 466 mile on it,When i asked how it had gone up i was informed they had been using it since my deposit was paid and the car now sold as a service loan car.I wasn't happy and asked them to return my deposit as i wasn't informed it was going to be used after i had paid my deposit.I then rang customer services to vent my surprise and disgust in the way that they had operated,I then received a call from the Branch offering me a discount on the vehicle as i hadn't been informed they where going to use it even though it was sold.I declined as i know how loan cars get abused,I have asked for my fuel and for a set of car mats that i had purchased to be reimbursed.They have refused as they said that when i found that they had been using it as they wished since i had paid my deposit ,that they had done all they could by offering to reduce the cost of the vehicle.I was a cash buyer and as such could of taken delivery of the car the same day ,if i had been informed they where going to use it this is what i would of done.I feel i have a right to reclaim my costs,Do i have a legal right due to the fact i wasn't informed they where going to be using the car since it was sold and deposit paid.Thanks for any help John

    OP, can't see it being overly abused for 341 miles in 2 weeks (24 miles per day) - sounds like you are being a little unreasonable to me. If it was me, I'd have taken the discount and driven off into the sunset.

    I would expect the car to be considered sold once the deposit was paid. Its your choice if you want to buy a reduced loan car. Presumably you paid for a tank of fuel which they would put in on the day of collection, no reason not to refund this .

    Asking on the consumer rights board might get better results.

    Personally I am always much more careful with courtesy cars etc as they aren't mine and I don't want to be stiffed with any nasty bills or the hassle on return.

    Why do you think he’s being unreasonable?

    He agreed to buy the car with x miles on it and they continued to use the car as a demonstrator/pool car.

    At the very least they should have told him and he could make his decision based on that.

    There might be no cosmetic damage on it but how can you tell the clutch hasn't been abused, given that it's had a couple hundred miles put on it by unfamiliar drivers? 2 years down the line it'll be hard to prove either way.

    If it was a 40,000 mile van I'd agree, but the loand quadruoled the mileage on it.

    It'd depend on the discount though - how much did they offer you?
