Being pulled in different directions

Hi there ...

Bit about the alleged debt ..
Date of contravention: 29th December 2015
Camera parking
The accusation is that of being parked when in actual fact with xmas shopping abd sales in a busy town centre ment the driver was stuck in "traffic" in the car park looking for a space and took around 20ish mins to get round and out again.

Had a few letters off whomever was asking for the alleged debt.. all not responded too now bw legal have sent a letter of claim.

This is not my debt and im neither the registered keeper or driver just after info. I know you guys are busy but ive been popping on and off here for a month or so now with no more understanding.

As the newbies threads states i should be writing and using the template letter for ipc members (vehicle control services limited)

Or have i gone past that and need to respond to the letter of claim? From bw legal.
If the latter is there a template wording to use? Because all the jargon is stumping my brain.

I have also been looking on a fb page for help and this is the suggestion

-Your response should note that as the keeper of that vehicle at the time of the alleged event you are denying any liability.
-You were not the driver
-You were of the opinion that the actual driver had entered the premises and failed to find a parking space so left.
-No abuse of the site facilities was undertaken.
-An offer to park was made when a space was not available Frustration of contract.
If this is a perfectly fine response ... How do i word it to send?

The letter received states the response time ends on the 21st march 2018. The letter came with a info sheet, reply form and income/expenditure form. Any response would be appreciated. :money:

    You are past the stage of template appeals.

    You need to robustly respond to the Letter of Claim as directed in post #2 of the NEWBIES FAQ sticky thread. There are sample responses there.


    Actually, forget all that.
    It is the Defendant that needs to respond to the LoC.

    I don't think many on here would support your idea of getting guidance from Facebook.
  • Its a facebook group set up for parking fines etc .. it was the first place i looked . Thata why i askes about their response on here thanks

    the recipient should have sent the template letter within 21 days of the postal notice, as KEEPER, to VCS

    that time has now passed as their solicitors are dealing with it, so as mentioned above the defendant (the person who received the letters) needs to rebut the allged debt to BW LEGAL

    they should not be surprised if this does nothing and later on they get an MCOL from Northampton CCBC (a court claim)

    That all depends, there's good and bad advice on Facebook.

    I see nothing wrong with the points mentioned above.

    You were clearly caught by ANPR cameras which do not
    account for traffic problems and therefore are not
    fit for purpose

    BWlegal are a "robo claims compamy" meaning that
    most of the time they actually don't know what they
    are claiming for

    At this point, you may care to get your local press
    involved to tell the story as you will not be alone.

    In the meantime, you can contact BWLegal and deny
    any debt and why. Ask them to prove otherwise that there
    was not a jam which the ANPR did not detect

    Facebook groups generally assist more on a one to one basis. (Not all groups are reputable)


    MSE requiring a more self driven individual to undertake their own research and build documents themselves. With lots of v good information from the stalwarts to assist and get up to standard


    Pepipoo very much harder to orientate and locate pertinent info for a newbie


    All good resources with good people behind them.


    By all means get second opinions, it!!!8217;s a scary old world and taking advice from strangers can be daunting.

    What happened when the Christmas shopping 'PCN victims' complained to the retailer Head Office about ParkingEye (I assume this was them, given the unreasonable and greedy haste to rush to court)? And/or to the Store Manager (not to the young girl on the CS desk).

    Complaining is the first thing the NEWBIES thread tells you to do, and if it is PE, then their User Manual positively provides retailers with a phone number/email to cancel PCNs whenever they want, for genuine patrons. That person kicks up a stink and the PCN is gone.

    The alleged occurred in 2015 , and it was not a shopping car park it was like a patch of concrete that had been brought by or governed at least by vehicle control services limited (thats the name on the letter and they are ipc registered). With anpr on the way in.. so it couldnt have been complained about to a store manager etc .. (i read that bit but fail to see who it could have been fussed too)

    OK, so VCS at somewhere like Albert Street B'ham (or similar place no doubt we have threads about - search!) and the keeper is getting threatograms from BW Legal, and has never appealed so the driver has never been divulged? And now it's at LBCCC stage.

    Nope you are past that so read the second post in the NEWBIES thread instead, about replying to LBCCCs.

    Read other BW Legal threads and respond as keeper, asking for all photos of the vehicle and the signs there on the day, and all documents and all evidence of any 'contravention'. In 2015 VCS did not use NTKs that could hold a keeper liable, so of course that KEEPER defends.

    We have 99% win rate here in defending these cases, helped hundreds in 2017. Just TWO lost.
