Ukpc

Hi,
I have looked for the general advice thread but the only sticky I can find is on POPLA appeals, so I am asking for some advice.

My husband received a parking charge on his windscreen 16/01/18. He ignored it. He says he did not see the signs saying private roadway. Anyway, today he has received a parking charge amount of £100.
Should he appeal it on the ukpc appeals website?
Any help much appreciated.
Thank you.

YES appeal, it will be rejected no doubt as UKPC are
    scammers who fake pictures

You will then get a POPLA code to further appeal

    Read up on UKPC here

    You now need photographic evidence

UKPC are fraudsters, treat them with the respect they deserve, read this

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.

Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Lega;, (who take hundreds of these cases to court, and nearly always lose), who have also been reported to the regulatory authority.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

I'm just about to submit the appeal. I have copy and pasted the appeal letter. I have taken a photo of the signage in the car park. It is really ambiguous. The car was actually parked in a dead end, not in the actual car park. There are signs in the carparks but nothing in the dead end. My husband was actually visiting one of the businesses in this retail park when he got the ticket and has dated minutes of that day's meeting.

Should I send the photo of the 'lack of signange' in the appeal and also the fact that my husband was visiting one of the businesses? Or just get a POPLA?

Send the initial appeal exactly as it is. Save the inadequate signage point, and all the other ones you will use , for your PoPLA appeal.

Complain to the landowner as keeper, and complain to your MP about this unregulated scam.

These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

    Thanks Fruitcake.

If Popla rejects my appeal, can I opt to pay the £100 at that point in time? Let's assume I don't want the chain letters and minimal court summons hanging over me.
How do I find out who the landowner is if it was a private site with lots of businesses attached to it?

Land Registry will tell you for £3.00.

Does the site have a name?
    Something like Xyz Business Park?
If so, googling it may well lead to the Managing Agents.

OK, so I'm waiting on a rejection from UKPC and a POPLA code.

The driver parked in a business park and attended a meeting at one of the business premises. The car park was full so the driver parked in a dead end. There were no signs directly on this piece of land, but signs in all the car parks. I am assuming that the dead end was part of the private land held by the business park.

The business has provided a letter on headed paper confirming driver was at thier premises when PCN was given .I have photos of the dead end and nearby signs.
Do I share these two things when doing POPLA appeal? If so, driver will then be identified.

I can also share the photo on here for your thoughts, but realise that this too could potentially identify driver, although driver's car is not in photo and I've not said when PCN was presented.
    Thanks in advance.

POPLA won't be interested unless the signage states (words to the effect) that visitors to the business premises are exempt from parking rules.
I have photos of the dead end and nearby signs.

Possibly more useful to you for inclusion in your POPLA appeal (depending on what the signs actually say). I can't see how providing a photo can possibly identify the driver.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
