Hello,

Firstly, I'm a complete newbie and have very little knowledge in this area (I have read threads but still not sure how to proceed).

I purchased a day ticket for the Indigo Lewes train station carpark. This was done via card payment and involved inputting my number plate. Because I input my number plate I assumed (foolishly) that I had paid and was 'in the system'. I didn't even realise the machine I input my numberplate on produced a ticket that needed to be displayed.

Obviously, I received a parking fine and appealed via the Indigo website. The internal appeal has been rejected and they are now requesting that I pay.

I have no proof of purchasing the ticket other than on my bank statement.

Do I need to pay up? Realise I was at fault for not displaying a ticket, but it's frustrating as I did purchase one. I have 14 days until it jumps to £100 (currently £60).

    You shouldn't have appealed but we are where we are. Did you admit to being the driver?
  • the car park will come under railway bylaws , failure to display is not a bylaw offence

  • Many thanks for the quick response. Unfortunately, I naively admitted to being the driver.

    Does it not matter that I don't have evidence for the purchase of the ticket (other than bank statement)?

    If not, do I just follow:

    1. Do nothing for now and wait for the notice to the keeper.
    2. Appeal to POPLA marking it as BYLAW OFFENCE.
    3. Prolong process longer than 6 months.

    You won't get POPLA this is a byelaws offence. The correct way to deal with this is for them to prosecute you in magistrates court.

    Luckily they seem very reluctant to do this as they get absolutely nothing in return. Some posters have gone the 6 months they have to prosecute without issue.

    Every time then send a letter respond with a question. Once 6 months are up you are home and dry.

    You cannot appeal to PoPLA without a PoPLA code supplied by the parking company.

    Did Indigo supply a PoPLA code?
  • not displaying a ticket (how can you by app) is not a bylaw offence and the land comes under bylaws , expect %^&*G hit from the likes of ZZPS

    Thanks all, I'm very grateful for the quick responses from so many knowledgeable people!

    No POPLA code. I initially thought I had to ask for one.. but obviously, I don't go that route.

    So do I need to respond to the email they just sent regarding the internal appeal? Or shall I just wait for the notice to keeper letter and keep responding with questions until the 6 months is up? Also, is it 6 months from the date of the parking ticket (already over a month ago)?

    a private company can send you an invoice , and can take you to CC however the land is not reverent for a PPC to work on , its a railway matter , indigo cannot pass your info to train Co,

    It is 6 months from the henious crime. I would be tempted to respond asking them if POPLA is available. Anything to string it out.

    As you know about POPLA I'm guessing their paperwork mentioned it? Another reason they are reluctant to do anything is their paperwork mentions POPLA. It could be deemed an abuse of process to offer you an appeal route then deny it to you.
  • They don't mention POPLA, I just got that from another thread.

    OK, I'll string it out another week or so, then ask for a POPLA code and keep delaying it.
