    It won't help you, but you could always check if the estate agent are going to chase them for the selling fees. If they signed the wrong agreement, they may owe them.

    The seller had a contract with out estate agents and the others. The sellers solicitors knew they were two buyers going for the house, but they are avoiding calls from the estate agents and our solicitors.

    The estate agents are pursing their costs from the sellers as they had a contract with him, which he breached.

    I am going to contact my solicitors on Monday about the contract race that some of you mentioned, to see if we can recoup any costs.

    My sister and i will have to find somewhere else to buy :-(

    Everything is for a reason i guess.

    Had you exchanged contracts? If so then you are in a strong position to get some kind of recompense. Speak to your solictitor about it if this is the case.

    What a dreadful thing to have happened & is every buyer's nightmare. I can only imagine how you must be feeling.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.
  • I have recently sucessfully sued my solicitor for misconduct, and i can see in this case that the oppositions solicitors were aware of fact but did not act upon, and therefore acted dishonestly.

    I would have a chat with the legal complaints team and see if you can do something through them, its a lot easier than you think

    Check this link out, i also have to complain about another solicitor who has not acted for me and the legal complaints have help me no end, finaly awarding me compensation of £8000

    Well it sounds like with the agents chasing for their fees and the possibility of solicitors chasing for costs the seller has built up quite a few problems for himself to deal with.

    If your solicitors had been sent contract papers and then they exchanged with somebody else without telling your solicitors a second set of papers was out, then the seller's solicitors would be guilty of professional misconduct. OP's solicitors would need to report the seller's solicitors to the Solicitors' Regulation Authority.

    Of course, what may have happened is that they never sent any contract papers out at all to OP's solicitors and kept silent for that reason. So OP does need to check with his/her solicitors exactly what they did receive.

    I really hope that you have some good news from this as from what the other posters have said it is illegal if you were not informed.
