ParkingEye and POPLA - a bonfire night scare

http://www.dailymail.co.uk/news/article-5400935/Couple-hit-100-fine-traffic-jam-row.html

POPLA, backing ParkingEye (quelle surprise there then) reckoned they should have got out of the queuing car and paid for more parking time. You could not make this crap up.

Luckily the local MP got involved, and this needs to happen EVERY TIME NOW:
But now Stockton North MP Alex Cunningham has called for action on parking companies after receiving complaints from constituents.

ParkingEye has since cancelled the Jacques' fine as a 'goodwill gesture'.

Mr Cunningham is backing the Parking (Code of Practice) Bill, calling for a standard code of practice on privately-owned car parks.

He said: 'Enough is enough. For too long private car parking companies have been allowed to get away with issuing fines and relentlessly pursuing payment, without any accountability or open process of appeal.'

A ParkingEye spokeswoman said the company followed the British Parking Association's 'strict' code of practice and welcomed any legislation that aims to 'drive consistency and improve processes'.

'ParkingEye operates an audited appeals process and encourages people to appeal if they feel there are mitigating circumstances.

'If a motorist disagrees with our decision they have the option to appeal to the independent appeals service (POPLA).

'In this case the parking charge has been cancelled as a gesture of goodwill.'
If that last bit was genuine sentiment, PE, you would have cancelled it BEFORE the MP and press condemned the 'outrageous scam' (Hansard, 2.2.18).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Another own goal for PoPLA!

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences. Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, who have also been reported to the regulatory authority.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.

PE needs to be reminded that under section 49 of the CRA2015 the service has to be performed with reasonable care and skill:-

(See section 54(7) for remedies available to the consumer).

With PE named and shamed by Hon Members, they should perhaps apply a modicum of common sense in issuing tickets in future.
