    The OP currently works for a care agency and is training for a new job in the NHS(?)


    The OP negligently leaves some confidential information visible, someone photographs it (are you allowed to do that?) and then informs the NHS trust where the OP is training for a new job? Possibly someone that she currently works with or has worked with, and is concerned about the breach of confidentiality, or maybe a relative of one of the clients? It was left in view, within the car, which was parked in the residents' car park (presumably meaning the car park of a care home or other place of work).


    Leaving aside the confidentiality issues, how does all this happen? I presume the "someone" is known to the OP, but how would they know to inform the OP's prospective new employer? If it is another employee, then it is feasible that they know that the OP is training for a job within a loccal NHS Trust - the OP might not have kept it a secret (and I'm not suggesting that she should have). If it is a relative, they may have been told by the person needing care that the OP is leaving to work at the Trust - care homes can be a hotbed of gossip!


    Seems a bit odd to me... Of course, in some parts of the country, half term was last week, and the OP is a newbie who has only posted on this one thread....

    You are confusing two things. You didn't breach the term of you contract with the NHS since you didn't have a contract with them yet. What they mean is that they will keep a note to say that you are not a good candidate to work for the organisation in the HR database. That's because organisations are at risky of hefty fines when a staff member break confidentiality, so they don't want to employ someone who has shown to be negligent. They might have said that it will only be on the file for 3 months and mean it, or not.

    What you've done though is probably breach the terms of your contract with the care agency, so what you do have to hope is that they don't find out.

    Indeed, it is an easy mistake to make when you are rushing and shows how important it is that confidentiality remains always on your mind the moment you hold something with patients/residents' personal details, whether it is on paper, on a usb stick or recorder. Regardless of what you think the risk is to the residents, what you need to keep in mind is the risk to you by not making sure you follow the rules.

    As well as being protective of data, you need to be seen to be protective of personal data. However, the data caution which has got you into this situation will probably work to your benefit, because the NHS won't justify keeping information about this incident forever. But do become fully informed about data protection as anyone who hears about the incident will probably ask about the topic in interviews.
