  • Well technically I wasn't employed by them as of yet, didn't sign a contract and was never paid for the training (even though I'm supposed to get paid for the training) and never got a payroll number of sort.
    But thank you for your advice, greatly appreciated, i fully understand and take full responsibility for my supidity.
    I think i will get in touch with a specialist to get more information as to how long they can keep a record on me and so on, many thanks :)

    Also, buy yourself a work-specific bag with a compartment to carry documents and always, always use it - that way if you do leave anything in your car again (which, as you're aware, you should never do anyway), at least the details won't be exposed to anyone who walks past...

    Go onto the Information Commissioners Office website.


    See how frequently NHS trusts get fined regulary over £50,000 for breaches of the Data Protection Act.


    YOU have breached the data protection act which carries a fine of up to £500,000 for the employer.


    Come May when that is replaced by new regulation GDPR the fines can be up to £20,000,000.




    Count yourself very lucky they aren't taking this further. Apply elsewhere and don't bother trying to apply to them again. They obviously see you as a risk and are unlikely to take that risk on. The fact you say "It's only names" shows you don't see the full weight of your actions.






    ALSO BIG SIDE NOTE:


    If you decide to contact a specialist and find out how long they can keep it on your file, you may find that by you poking at them that they have to report it as a DPA breach to the ICO and it can then become a legal issue for your record.


    You don't seem to appreciate your lucky escape with them.


    Under the Data Protection Act, although there is no legal obligation on data controllers to report breaches of security, many choose to do so and we believe that serious breaches should be reported to the ICO.


    Notification of personal data breaches will become mandatory when the General Data Protection Regulation comes into force from 25 May 2018.

  • "It's only names" - so let's imagine for one moment that a close relative of yours was on the list. Would you still be saying the same? Or would you be concerned that a vulnerable person had their confidentiality compromised?

    I suggest that you learn from your mistake and take on board the excellent advice from posters above. Hopefully the care agency will keep you on, but you might need to learn more about data protection and safeguarding.
  • Locally there was a carer who had her car broken into and her bag (including rota) stolen. In following weeks several of her clients were subject to distraction burglaries. The thieves had followed the carer round and matched names to addresses. The distress of those victims has been immeasurable (one is a family friend, she's now in a care home as she can't stay on her own).

    That's what can happen when you are lax with other people's personal data.

    The fact that you keep repeating 'it's only names' just shows that you are not taking it as seriously as you ought.

    It's a breach. There aren't levels of breach, or acceptable breaches, or somewhere where you get to have your day in court to put your side of the breach.

    You work in care - you breached confidentiality of your clients.

    Therefore an organisation does not want to take the risk that you do not take confidentiality seriously enough - if you were their employee they would get fined. They therefore aren't going to be your employer because they don't need someone who considers it 'only names'.

    The person who took the picture was absolutely jobsworthing - but if you hadn't left it there, they couldn't have taken the photo.

    Stop saying 'it's only names' and start saying 'oh my god I did a terrible thing' and perhaps your employer and future employers will see you taking on responsibiilty.

    All the way through this you have said 'it's my fault' but followed it up with 'but it wasn't a big mistake'.......... yes, it was, because a breach is a breach is a breach.

    Sorry, but I don't think this employer would entertain any future application - however, there isn't a 'central register' or the like, so it won't be 'on your record for life', or shown up on a DBS - it's just that you have squared your pitch with this company.

    I am amazed that your current company hasn't fired you to be honest, or at least put you through a disciplinary procedure and retraining.

    The OP negligently leaves some confidential information visible, someone photographs it (are you allowed to do that?) and then informs the NHS trust where the OP is training for a new job?


    Leaving aside the confidentiality issues, how does all this happen? I presume the "someone" is known to the OP, but how would they know to inform the OP's prospective new employer?


    Seems a bit odd to me...

    that doesn't happen any more in our local hospitals. You ask at the ward reception desk and they tell you which bed your visitee is in.

    It does happen in some places, BUT the ward is not considered to be 'public'
