    As for the latest Gladstones case win I've been through about 10 threads and I can't find it. I may be blind but please link me too it here.
    Only ten threads? We read every thread, every day. I am not saying that to be funny. You need to read more threads (I am not joking, being fully prepared and being able to easily search the forum is key).

    You could have found it in less than one second, by searching 'UKCPM' on this forum.

    The search takes half a second and it would have been the second to top result, after your own thread.

    @CM You are one of a kind. I hear you 100% i'm just trying to juggle like all of us family time, managing my own business and training for an ironman. It's fairly intense but I wouldn't have it any other way.

    Not yet, I think it will confuse everyone to be commenting on a defence and WS before a claim is even made. And your defence and WS might well change based on what happens in between (e.g. a WS can be used to tear into the other side's WS).

  • Many thanks CM I will keep you all posted on any updates. As it stands my latest reply was via email to Gladstones and they responded asking for a letter before claim number starting for 10 which I don't think I have at this point before the court claim. I gave them my DRP reference instead.

    I suspect as with many people here that they will send me a court letter that is very close to the actual court date. If that is the case I assume I can use that as a part of my defence?

    Not sure I understand this? What is 'starting for10'? Why would Gs be asking you for a LBC?

    There is no court date allocated until all of the prior paperwork and procedures have been dealt with. While not a standard, many court cases don't get to a hearing stage for a number of months after the paperwork etc has been completed.

    Nothing should be sprung on you unannounced.

I received a response from one of their email addresses asking for a letter before claim number beginning with 10. Is what they are asking for premature at this stage as I haven't received a court letter yet?

    I also have a slight concern that I may be out of the country from August onwards. Is this likely to take that long to process? I don't want to incur extra flight & time costs in order to deal with this

    I think I'm trying to understand this - but tell me if I'm wrong.

    DRP send out letters under Gs letterheads and use reference numbers 3xxx or 4xxx. When Gs send a letter (possibly later in your process) that will have a 1xxx reference and is likely to be headed 'Letter Before Claim' (or very similar).

    Gs seem to be trying to find your papers (which they won't yet have as DRP haven't yet finished their side of things). This is my summation, but do tell me if I'm wrong.

    It might be better, as we are flying a bit blind by trying to interpret your description, if you link up a redacted scan of the letter from Gs. That will provide a clearer picture.

    When (and it's only an 'if' in your case at the moment) a case is allocated to the defendant's local court, the defendant can provide the dates during which time he/she is not available, and where practical, the court will fit a hearing around those.

    ASsuming this is also the same as the Pepipoo case,Redivi (Gan) has already suggested holding fire on any response

    GS have effectively confirmed that the letter from DRP using their letterhead was a fraud, a false instrument, as they have no record of the letter.

    Assuming GS then submit a claim form, they cannot deny knowledge of this fraud.

    First of all thank you for all your responses. I started thread on both forums around the same time as I was unaware that many of the same people would be posting on each. As it happens I have received various similar but differing responses on each which I am very grateful for and have been of great benefit. I hope they will also be of benefit for other people that find themselves in a similar position to me.

    I believe as Redivi mentioned that DRP are clearly trying it on by pretending to be Gladstones. However I did respond to Gladstones to give them the DRP code and say that there was no number beginning with 10 (letter before claim). I hope that my response to them is not going to be an issue moving forward.

    @ukomaas I've uploaded 2 of the Gladstones letters for reference below. I've received 3 of these supposed fake Gladstones letters, 1 for the first pcn and 2 letters sent on the same day for the 2nd which seems absurd. Looking forward to hearing your thoughts.

    Are you all in concurrence about what Redivi has suggested?

    I also plan to leave the UK for good in August and understand that I can defer any court case that may take place but I am wondering at this stage how much longer they are able to drag out the potential for the court case happening.

    I can easily envisage the need to fly from somewhere else in the world to attend a court case in the UK which would be a bit of a disaster.

    This may of course not go to court eventually but I want to be absolutely prepared.
