Having a £0 tax car doesnt absolve you from your legal requirement to keep it registered.

Thats what the fine is for.

The V5 is to keep it registered; the tax is to erm, let me think, pay tax maybe?

None of which change the fact the fines are disproportionate to the crime and nothing less than money making exercises. Anybody that thinks otherwise has been brain washed by self serving politicians
  • The trouble is that if the fine was something like £25, it would not be a deterrent.

The V5C needs to be at an address at which he can be contacted in a timely manner. Fail.

The VED is partly to pay for the car's use, and partly to flag the car as being in use, check (once a year) that it's MOTd, and check (constantly) that it's insured. Fail.

These are not hard concepts, and the OP's son is bang-to-rights.

    OP's partner, surely?

My bad. The son might use it, but the partner is the one legally responsible.

The other thing is, of course, that if it's not taxed then it needs to be SORNed - for which it must be kept off the road. So the OP's partner has breached those regs, too.

They are being fined for not registering, not for not paying nothing.

    Read the op again.

It is a vehicle licence to use the vehicle on the road - the only vehicles who do not require a licence are exempted vehicles, all other vehicles require a licence but some need to pay for the privilege.

Technically - by the letter of the law - you should receive a criminal conviction and a fine of £1000 or 5 times the duty chargeable (whichever is greater). Now THAT would be disproportionate
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • Thank you all. The vehicle checks were all done - his son had gone through all the process and got to the £0 to pay page and thought that was it. Unfortunately there was one final stage where you have to effectively put in details for payment to pay nothing, which he didn’t realise. My partner checked with him that he was doing it and both thought it was complete. There seems to be a flaw in the process on the website which catches people out.

His insurance know and his driving licence details have also been updated, so everything else is in order. Just again seems crazy that he is being fined for paying nothing... yes do feel it is an easy target for extra money.

hardly, it's quite clear when you have taxed the vehicle or not
