Faulty Xbox One X from Currys advice

Apologies in advance. I'm sure Currys have a bad enough rep around here, but another one from this confused consumer.
Purchased Xbox One X from Currys late November 2017. Recently developed a fault where it wont play games. Have been speaking with Microsoft all week to try various remedies, nothing has worked, so the advice was to return to the retailer (Currys)
Did so yesterday and advised of the issue. The guy said his line manager informed him the only course of action was for me to contact Microsoft with a view to them repairing, as I had taken out no extended services with Currys. He offered to do this for me to be fair, but I decided to make contact myself.
I am to send the console back to MS for repair, but they have stated that if the fault cannot be repaired, then a refurbished console is what I will be provided. I just want to check with more knowledgable people than myself if this is correct? I'm struggling to see how I may be provided a refurb console, after only paying full price for a new console not 3 months ago? I'm sure its tough luck, but it doesnt sit right with me.
Does this advice ring true, or should I be asking for a replacement device as I dont want a refurb console, having paid for a new one?

You paid for a new one, but you no longer have a new one. So swapping your 3 month old one for a new one would be betterment.
Most refurb machines are just as good as new anyway, whether its Apple or Microsoft etc.0 -
The legal position is (assuming an inherent fault has been accepted) that the SELLER must provide a remedy ... Repair, Replace or Refund (in full as it is less than 6 months since purchase). The buyer can express a preference but the seller gets to choose the most cost-effective remedy.
A repair is as it says. A replacement must be at least like-for-like (so replace a 3 month old faulty unit with a 3 month old non-faulty unit). Therefore a refurbished unit (3 months old or newer) would be in accordance with your legal rights and the seller's liabilities.0 -

Thanks. Makes sense, but maybe I suppose I'm used to the Amazon service.... they would look to replace on the 364th day, think I'm a bit consumer spoilt!

And that is where you find the quality of the retailer you've chosen. Some go above and beyond, others fall well into the bare minimum and some go below that (or try to).0 -

And thats my issue, I was wondering are Currys trying to go below that! Clearly in this instance they are doing, as you say, the bare minimum to ensure they comply with requirements.0 -

What people don't seem to understand is that some of the better retailers will price match Curry's and the like and give a superior service and or guarantee.0 -

Agreed! I've said this several times and theres always the 'deal' that gets me buying from there, against my better judgement. I think this will be the last straw though, no more!0 -
John Lewis will price match with free two year warranty.
I always buy my electric goods from them or richer sounds for a new telly !!!55357;!!!56842;0
