    Hi
Was there an result/update to this post by MiiCK90? I am very interested as I have just received my first (and hopefully last) Charge Notice and the circumstances are exactly as those posted by MiiCK90. I too am new to forums, I will read the NEWBIES thread - can I just check its accessed here - NEWBIES!!! [Sticky Thread Comments Archive (approx. 17 pages worth?)] (sorry not techy or good with computers and still trying to find my way around). Or if anyone aware of posts for similar situation, would be interested to know how to locate. Thanks in advance for all your help. :)

It's the thread at the top of the board that tells Newbies to read it first.

If you have questions you need to start your own thread.

No, see my signature for where to click to see the NEWBIES FAQS thread 'stuck' (as all sticky threads are) near the top of page one of the forum.

CP Plus are easy to beat by appealing as registered keeper, as per the sticky.

    Dear Sir/Madam,

    Re PCN number:

I am the keeper of the vehicle which received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable.

Should you fail to cancel this PCN immediately, I require the following information with your template rejection:

    1. Does your charge represent damages for breach of contract? Answer yes or no.
    2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
    3. Please provide all photographs taken of this vehicle.

I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.

I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.

If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.

    Yours faithfully,

I have just prepared my letter, copying the above.
I have opted not to use their online version as it requires confirmation that I was or was not the driver
Tick here to confirm that you were the driver and that the PCN you have received contains the correct information

My query is however relating to POPLA.
I've read elsewhere that POPLA is only for England and Wales, however the PCN I have received is related to parking in Hamilton motorway services, Scotland.

Is there a different process I should follow for appealing parking fines in Scotland?

Thanks in advance for your advice and guidance.

  • Apologies, I just found this
Q - ''I'm in Scotland/NI, so is the advice different?''

A - IF THE EVENT TOOK PLACE IN SCOTLAND OR NI, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, BUT DO NOT APPEAL, UNLESS YOUR CAR IS A COMPANY/HIRE/LEASED VEHICLE, IN WHICH CASE, APPEAL AS HIRER/LESSEE (SEE * AT THE FOOT OF THIS POST).

IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.

IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS.

So it appears that I should just do nothing other than keep the letters.
Its issued from PO Box 3573. Barnet, EN5 9QA, so presume despite it being issued from England, the motorway services was in Scotland so I should just hold my nerve.

Appreciate if any experiences forum members can confirm and ease my concern.

You need to start your own thread and not hijack someone else's like this.

Though the FAQ you have belatedly now read is up to date and you don't need it confirmed

    Thanks for your responce.
i did not want to start a new thread when it appeared that there was a thread already for CP Plus, as my PCN also relates to.

I did not realise this was a unique case, but thought it was the best place relating to a CP Plus claim

The wonders of the internet and search capabilities, I did not start from the MSE forums home page and navigate to here, but hyperlinked directly into this thread from my google search.
I therefore had not seen any Newbies thread to start from.

Thanks for this and taking the time to reply, but am sure a simple yes would have sufficed.

Apologies if I have misinterpreted the tone of your reply.
I can empathise both with the repetitiveness of post the "experts" are responding to and the "newbies angst" to seek advice

The longer reply than you wanted is not really for your benefit, but to get the message to other newbies reading it!

This forum is different to the main forums here in that this isn't the "CPS discussion" thread.

Each thread "belongs" to the OP,s PCN, and when posts are OT it just causes unnecessary clutter in the thread - your topic was really to do with parking in Scotland!

I'd send the template appeal anyway and add that land in Scotland is not covered by the POFA so as registered keeper you have no liability.

Won't hurt, and we found that Highview (another PPC) cancelled when they saw a similar appeal re a Scottish site.

  • Hello I run a few vehicles for our company and one of our lads has had a fine from CP Plus. I have tried to call, but all they give on any option/number is payment unsurprisingly, you cant actually talk to anyone though it states that you can, and I quote "if you wish to contact us by telephone regarding any other matter please conatct us on 0333 939 0104"

Would it be a bad Idea as a Company, rather than an individual to go through this cut & Paste process, on Company Letter head communivcations.??

They have put entry, & exit a image of our car, the driver is indistinguishable and they have put what it seems a PDF image of a sign not relevant to the site at all??

    Any advice would be appreciated.
