Outstanding PCN, no NTK received

I have received an Outstanding PCN from TNC on behalf of P4Parking dated 27th January. The original charge date was 30/10/2017. There was a window ticket but I am the reg keeper only. Letter says the time to appeal has passed.

Letter received starts saying:
´Despite our letter of , your PcN has still not been paid ......´
I´m sorry, Despite your letter of what???? as I haven´t received any other letters. Can´t find anything on Newbies, please direct me to the right post if available. Otherwise any advice on how to deal with this is appreciated.

    Appeal using the template from the NEWBIES, stating that as this is the first communication you have received, and therefore cannot possibly have responded to it, you are treating it as the NTK.

    In addition, complain to the landowner and your MP, pointing them to last Friday's parliamentary debate where all parties lambasted the unregulated private parking industry.

    Also complain to the BPA that one of their members is telling lies, again pointing to the above debate where MP Peter Wishart said, The British Parking Association is about as much use as a multi-storey car park in the middle of the Gobi desert.
    Ask them how they intend to change their image in the eyes of the UK Government, and the motoring public with regard to rouge parking operators such as P4parking.

    Appeal to the PPC. I believe TNC are debt collectors who can safely be ignored, although you could copy your appeal to P4 to them if you wanted. I suggest you ask for a copy of the letter they told you that you allegedly sent with your appeal.

    It won't make any difference I suspect. Parking scammers tell lies as you are now aware, so the mostly likely response is, we sent you a NTK before and you are now out of time to appeal. If that happens, then you just keep firing complaints to the BPA, telling them the scammers have lied to you, each time referring to the MPs debate.

    Please do tell your MP though. It is because others have done so that it is at last being debated in parliament, and reform is likely to happen as a long overdue result.

  • I have followed the advice above. Today I have received a further letter from TNC that reads: Notice of intention to advise client to issue summons.
    Letter is dated 9th February, has been received today, the 16th and says that unless settlement is received within 7 days of the post mark they intend to advise the client to instigate immediate legal proceedings. Those 7 days have already gone.

  • I am in the process of writing to my local MP and I know you are telling me to ignore this letters but I wouldn´t like the next one to be a court summons.
    Should I write back to them stating that their client has not followed all aspects of the BPA and that I am appealing to them?

    when a debt collector says this then you know they are loosing ...

    because they will not get paid if the PPC has to do court ....

    you can if you wish write to the PPC ... but it will have no effect .... write to the BPA if you want to keep up the letter ping pong

    Engaging with a debt collector just encourages them,!

    But it's your call.

    Have you checked out the ppcs approach to going to court on the bmpa website??

    (They do have 6 years to take legal action so no-one can say what their approach will be over the next 6 years)

    I think I would reply with a version of the letter you will find when you search the forum for the single word: 'cathartic' and change the search default to 'SHOW POSTS' (NOT threads) by Johnersh.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Brief update: got a very politically correct reply from my local MP.
    The BPA do not give a toss about whether their members fall below the standards of their code of practice. They just don´t care and will not do anything. What a great business instead of getting 80-100 pounds from a straight forward notice, avoid informing the driver and instead charge them 175!
    Received my first letter from P4Parking informing of the intention to start court proceedings if I did not pay within 10 days. No acknowledge of my previous emails.
    Have written to P4Parking following advice, had to pay special recorded delivery with proof because the clever guys only have a PO box as address. Offered to take their letter as the first notice but 10 days on have had no reply.
    Also wrote to the debt collectors enclosing a copy of the letter to P4Parking and asking them to stop while the issue is being resolved under regulation ladiladila.
    Anything else I can do?
