County court buisness centre claim from CEL

Last week I received a claim form from the county court business centre Northampton for a fee of £328, the claimant is Civil Enforcement Ltd for a parking charge. I received a parking fine just under a year ago for parking in my Doctors car park as a patient which I attended a couple weeks earlier. I was oblivious, they'd never had a parking system in place previous and i'd been a patient there 20yrs+. I went to check it out and they had signs up and a camera in the car park that I did not notice on my appointment at the time. You just wouldn't expect it being quite a residential area. So I went to reception to explain that I was unaware of it and asked them to help me out. The receptionist with a bad attitude said it's been in over a month now, you should of seen the signs. Then held up a piece of paper saying the only way you can have it dropped is if 1. you entered your car reg into the touch screen inside wrong or 2. you simply turned around in the car park. No good to me as i was completely unaware. They made no attempt to give me a heads up when making an appointment or on arrival at reception even though it was new. I just binned the parking fine, was wound up! I missed the appeal date then received various same old... threatening letters off zzps, Wright Hassall Solicitors and Civil Enforcement Limited demanding payment with the fee rising each time. I was never going to pay a parking fine. The new system had specifically been put in to stop people who weren't attending the Doctors parking there, not to catch unsuspecting patients out.

I've put the above background info in this post in case any of this has any relevance at all in helping me.

Not sure where to go with it from here now? I know ignoring it is not an option. I dispute it all but have got 5 days left to put up a defence. I will use the Acknowledgement of service for an extension for an extra 2 weeks. Any advice or help on how to go about putting a credible defence together would be much appreciated thanks!

    1) read post #2 of the NEWBIES FAQ sticky thread near the top of this forum

    2) search for and read a dozen or so recent CEL defence threads since oct 2017 on this very forum and then draft your own defence based on those others , adapt to suit

    and if you never revealed who was driving to CEL or anyone, edit post #1 and remove any hint of who was driving , or do you not think they monitor this forum ?

    what happened on the day happened to THE DRIVER

    what happened since that day happened to THE KEEPER

    those are the only 2 descriptions you need

    ps:- you did NOT receive a "fine" - its not a fine

    its an INVOICE purporting to be a "fine"

    SO remove the word FINE from your head, legally its a parking charge notice, a PCN, an INVOICE , nothing more

    You MUST complain vehemently to the Practice Manager.


    When my surgery appointed a PPC I let the Practice Manager know what murky world he has let himself and the practice into.


    He replied:-


    Thank you for the additional details. I can confirm that as a private car park we are aware of our responsibilities in using a car park management company. The company are aware of our patient and staff requirements, but should there be an issue with an incorrect parking control notice being issued in error, then the Practice can direct them to rescind this PCN.

    Please complain asap.

    Have not yet been able to obtain a parking invoice so have not put his promise to the test.

    It is a scam. That amount is 50% more than you woild be likely to pay if they took you to court and won.


    Esee what MPs had to say about these companies in the Hof C last week, with a fair wind they will be toast by Christmas


    Whether you get court papers or not, this is a scam. Watch what MPs said about these crooks last week in the HoC and complain in the strongest of terms to your MP
