Indigo ARE still getting details from DVLA...

  • Should have a definitive answer on Saturday re Indigo and accessing DVLA data. The subject access DVLA email should work PG, I used that for vehicle keeper data and DVLA said they can't reply by email but have sent info to RK address 1st class mail. Away until Sunday, but on Sunday will find out who accessed my data for an Indigo managed car park and an Adaptis request for money. It can't be Adaptis - they're not ATA registered! My guess is Indigo are accessing.
  • Hi there, here's the response I got from the DVLA. Please would those in the know advise if Indigo have done anything wrong re. the data request? Many thanks.

  • Clearly either Indigo or the DVLA were being economical with the truth when saying they were not requesting keeper details. Oh well .....seems to be par for the course. The DVLA has told me magnificent whoppers in the past (and yes, I do have incontovertible proof).

As usual, Indigo are mixing up contract and byelaws terminology. The penalty notice is all about breach of the Byelaws - yet the request to the DVLA was for breach of terms and conditions of parking. A byelaw is a rule laid down by the State - nothing to do with terms and conditions which can only apply in a contractual context.

Apart from that the requests seem to be OK. It's what Indigo do with the data afterwards that is unlawful.
