    Whatever way is easiest. I'd do email, and keep a copy.

    Find a robust pre-action reply to BW Legal by searching the forum for these obvious keywords:

    Searching Google and the forum is very very easy. It's all about the keywords. Can't stand seeing people type an entire question or phrase into Google - complete with 'the' and 'a' - makes me laugh or cry, not sure which. Just daft.

    So I have to go to court next week. I intend to read over everything here and refresh my memory with all the details as I would have forgotten it if I had read it all previous to now!
    Ive just done my costs schedule and wonder if £183 is unreasonable?
    Also Ive looked here to find out where I actually present the costs schedule but cant find it. Do I take it with me to the hearing or do they need it beforehand?

    Send your costs schedule to the court and to the claimant around 24 hours before the hearing. Email is fine.

    Take copies with you to the hearing.

    Both, and also print out proof that you emailed it to the court and the Claimant.

    Read this, FlyingHorse got awarded £550 in costs today, due to the claimant's unreasonableness (you need to explain this to a Judge and it is rare to get that much awarded).

    Well Ive been to court. It wasnt a bad result but I dont feel at all victorious! Got 262 reduced to 140 But I forgot to mention costs, I thought that maybe costs were only payable if I had outright won the case. Is it too late to apply now and if not, what is the process does anyone know?
    Also the judge refused to look at the more recent ticket I had, he said to talk to the agent who was there to represent BW Legal, but she shot off very quickly. I would like to get this dealt with asap as I would love to draw a line under it.

    Hang on, are you saying the Judge said you were liable as keeper, for a pre-POFA PCN where Excel were banned by the DVLA at the time for saying the same thing? What was said? This makes no sense.

    The judge said that even though it was pre-POFA that I had still parked there and that whatever the law was, that I had entered into a contract with the landowners

    Did you admit to parking and blew the 'no keeper liability' argument then? Had that already been admitted, why?

    Surely after 6 years you can't recall who parked, therefore your argument was absolutely that you couldn't be held liable on an assumption you might have driven?

    He pretty much poo-pooed the bundle I had got together and said although it showed I had done the background work that most of it was irrelevant as it didnt count as evidence. He said that if I wanted to campaign then to go and campaign but I was there to defend myself.

    No I didnt admit to parking I said that I knew it wouldnt have been myself as the car park in question has such a bad reputation for chasing after people for varied reasons and slapping these high fines on them that, like most people I refuse to park there. I pointed out that it was at a time when 'keeper liability' didnt stand and that I didnt know who the driver was, that the car was insured for people other than myself and that I wasnt prepared to even guess who might be driving on the day in question, especially that it was so long ago.
    He just focused on how long ago it was and that was the reduction in the final figure, having removed the interest etc, and admin fees
