Help completion tomorrow

Honest this house buying has been an absolute rollercoaster. Completion is Tomorrow asked hubby to ring estate agents to discuss handover of keys ( you literally have to go into the minute details with this estate agent) ewe move !!

Estate agent says he hasn't got them as gas engineer has them ?? one of the hold ups has been getting a gas safe certificate from them my solicitor actually requested the guarantee on newly installed boiler ( which we haven't got ). And they have completed a gas safety check ...is this standard when buying a house?

Anyway that's another issue . I query why still considering check already been done and we received email confirmation that it's passed and certificate in post and we agreed to set completion. apparently when gas engineer went to do check the boiler is leaking. Now either it didn't pass originally as stated and estate agents lied or the engineer is lying. Surely he couldn't pass the boiler if it was leaking ? Estate agent now says do u need keys tomorrow so engineer needs fix job and one set of keys.

I've got people set up to start work this weekend. Good job there's no chain. Where do I stand now. I feel like I haven't got any choice and to late in day to stop sale and I just have to go ahead ? That boiler is my problem from tomorrow. At this stage I don't know how bad this leak is. I am just concerned as I wasn't expecting this expense. Any advice legally? How do I play it ? Just pray that they do the work ?

    Why have you exchanged if you've yet to see the gas report you wanted?

    Or if you are planning to Exchange/Complete same day, then your opening statement "Completion is Tomorrow" is incorrect.

    If you have, indeed, exchanged and Completion is tomorrow, then

    a) th gas report is irrelevant now and
    b) it is up to the seller to arrange a key for you tomorrow somehow or be in breach of contract for failing to Complete.

    I know my husband agreed because they told us it had been issued but takes 10 -15 days to get hard copy. They told us they would send electronic copy to solicitors but just sent an email confirmation. I stupidly trusted. Exchange was Tuesday and competition sent for Friday

    as i said, since you've exchanged, it's too late re the gas stuff. it will eitther come or not come, but you'll have to Complete either way.

    And he seller will have to give you a key.

    So I don't really understand the issue.

    If you're worried about the key, ask your conveyancer to ask the seller's conveyancer to confirm how the key will be handed over.

    If the gas engineer needs a key for tomorrow because he's working on it tomorrow, you can just go to the house then ! Doh !

    However, the EA usually is responsible for holding the keys and again "usually" I'd expect the vendors to drop at least one set round to them when they move out.

    As per other posts I dont understand why you exchanged if you dont have a gas safe certificate if thats what you wanted though AFAIK its not mandatory. Who is paying for this engineer?

    Unless of course you want to give up your 10% deposit.

    Yes! You have exchanged and are legally committed to buy it. Either your solicitor is useless, or you've chosen to ignore advice, or not understood things they've explained to you.

    Sounds like OP should not be considering whether or not to continue with the purchase, but whether or not to continue with the marriage!
