Hi all, I wish I'd found this site prior to sending my 1st appeal to Parking eye.
My Sons christening on the 21st and the "after do" was at a restaurant called Tinos. With a parking eye car park opposite. I paid as can be seen and over ran by 10 minutes. It was snowing that day and imagine carrying a baby + all the presents etc it took an age! Anyway, I submitted my own appeal on the grounds £60 was "unjust" for over running 10 mins.
Then I came here, so I read the newbies post and copied and pasted the template and submitted a new 'appeal by checking a box which said I hadn't appealed (their site alerted me I had already done so).
Firstly - anybody else done this?
will the 1st submission affect the 2nd?
And do I just wait for it to be declined and go to POPLA

I must add that there's a few of my guests that received PNC's.
I've called the restaurant and they don't know who owns the land...How do I find this out? I'd like to upload an image but not sure how to do it on my phone as is asks for a URL. Not from gallery like other forums.0 -
parking eye are a member of the BPA
BPA state there must be a grace period ,
if your event was january 21st , it comes under new code of practice
13 Grace periods
13.1 If a driver is parking without your permission, or at
locations where parking is not normally permitted they
must have the chance to read the terms and conditions
before they enter into the !!!8216;parking contract!!!8217; with you. If,
having had that opportunity, they decide not to park but
choose to leave the car park, you must provide them with
a reasonable grace period to leave, as they will not be
bound by your parking contract.
13.2 If the parking location is one where parking is normally
permitted, you must allow the driver a reasonable
grace period in addition to the parking event before
enforcement action is taken. In such instances the grace
period must be a minimum of 10 minutes.

Looks like I was just over the BPA minimum 10mins grace then as;
Arrival time was removed as advised
Departure time was removed as advised
Wonder if adverse weather comes into it since I was carrying a baby across An icy carpark?0 -

The precise times on that PCN together with the location are enough to uniquely identify your parking incident.
You would be wise to disguise the precise times in that image, and from your earlier post.0 -
You have two grace periods;
1) At the beginning they must allow you time to find a parking spot, read the signs and if necessary, to pay. AND
2) At least 10 minutes to leave the car park at the end.0 -

Parking was paid for 4 hrs so it looks like I'm 10mins and 6seconds over.
As stated previously 10mins is a minimum so I could still be below if it's over. But why would a scum company like these offer anything above the required minimum!?0
