First Time Buyer Stamp Duty - Tenants in Comomn

I’m buying a house with my partner. He is a first-time buyer, and I am not. Can we still get Stamp Duty relief? I know usually we probbaly can't, because I am not a first time buyer. But what if we choose "tenants in common" rather than "joint tenants" on the mortgage. Will my partner get stamp duty first time buyer exemption?

  • It's still a joint purchase, and a single payment of stamp duty covering both of you. So you'll be unable to claim the discount.
    *Assuming you're in England or Wales.
  • Even if we are tenants in common rather than join tenants? With tenants in common each owns a set share - this can either be half each, or a defined percentage. But with joint tenants, you both own all equally. I've been told with tenants in common the first time buyer still gets their stamp duty discount, but wasn't sure if that's totally true.

    You have been misinformed.

    Both purchasers have to be FTBs to qualify for the SDLT exemption.

    I am first time buyer, but partner is not we have joint mortgaged and have to pay stamp duty, no way out.
    Just this morn letter from buyers EA saying completion how do you say , is completed. So after 5 months hard slog next Friday the trials and tribulations of moving a ton of stuff and finding out whether you did the right thing or not comes clear.
